MITCH OF THE CHICAGO,ROCK ISLAND & PACIFIC RAILROAD COMPANY, RUNNING
THENCE IN A NORTHWESTERLY DIRECTION ACROSS THIRD STREET AND CROSSING
OVER FERRY STREET TO A DISTANCE OF ABOUT 110 FEET FROM THE POINT OF
BEGINNIA4,TO THE SOUTH EAST CORNER OF LOT ONE,BLOCK ELEVEN,POPES
ADDITION TO THE CITY OF LITTLE ROCK FOR A PERIOD OF TEN YEARS, FIXING
THE AMi�L KTAI, TH2REFOR AT $75.00 AND FOR OTHER PURPOSES. �
II''ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. That, for and in consideration of the payment of
Seventy -five Dollars ($75.00) per annum, payable annually in ad-
vance, by the Kroger Grocery and Baking Company, its' successors or assigns,
the said Kroger Grocery and Baking Company, its successors or assigns, is
hereby granted the right to maintain for a. period of Ten (10) years
a single spur track from the Third Street switch of the Chicago, Rock
Island & Pacific Railroad Company, running thence in a northwesterly
direction across Third Street and crossing over Ferry Street to a
distance of about One Hundred and Ten (110) feet from the point of
beginning, to the South East corner of Lot One (1), Block Eleven (11)
Pope's Addition to the City of Little Rock, Arkansas.
Section 2. That no cars shall be permitted to stand upon the
street, or sidewalks intersected by said switch, and said switch shall
in no way interfere with the traffic on said street and sidewalks: that
said Kroger Grocery and Baking Company shall build and maintain, free of
cost to the city or public, if the remaining part of said street shall
be paved or macadamized during the continuance of this grant, a pavement
of like character or material between the rails and two feet on each
+i�s#de thereof; that said switch shall be maintained so that the top ;
of the rails of same shall be on a level with the grade of the street
as it is now or may be hereafter established, and shall be maintained so
as not to interfere with any waterway or flow of same, and the city shall
have the right to alter said grade at its pleasure; that said Kroger Grocery
and Baking Company shall hold the city harmless from damages of any kind
occasioned by maintaining said switch., or the use of the same.

Section 3. That said Kroger Grocery and Baking Company shall,
within twenty (20) days after the passage of this ordinance sitnify
its acceptance oz the terms and provisions thereof by proper certificate
and endorsement on the record thereof-. That all rights herein granted
shall cease and determine on and after ten (10) .years from the date _
