AN ORDINANCE GRANTING A.TznNBAUM-THE RIGHT TO MAINTAIN A SPUR OR SWITCH TRACK ON EAST THIRD STREET ABOUT THREE HUNDRED FEET EAST OF THE EAST LINE OF RECTOR AVENUE,AND EXTENDING ALONG AND ACROSS SAID THIRD STREET AND RECTOR AVENUE IN A NORTHWESTERLY DIRECTION TO THE SOUTHEAST CORNER OF BLOCK TWELVE POPE'S ADDITION TO THE CITY OF LITTLE ROCK AND TO SUCH OTHER POINT UPON ITS OWN PROPERTY IN SAID BLOCK AS IT MAY DESIRE,FOR A PERIOD OF TEN YEARS, AND FIXING THE RENTAL THEREFOR AT 425.00 PER ANNUM AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: Section 1. That for and in consideration of the payment of - a t Da3lars ($25.00) par: vane by A _f, °Tenzmbaum, his successors or assigns, the said A. Tenanbaum, his successors or assigns, is hereby granted the right to maintain for a period of Ten (10) years a single spur track from the end of the sour track or switch now laid on East Third Street, the said end being about three hundred (300) feet east of the ea-at line of Rector Avenue, and extend the said switch along and across said Third Street and Rector Avenue in a north- westerly direction to the Southeast corner of Block Twelve (12) Pope's addition to the City of Little Rock, and to such other point upon its own property in said block as it may detire. Section 2. That no cars shall be permitted to stand upon the street, or sidewalks intersected by said switch, and said switch shall in no way interfere with the traffic on said street and side- walks; that the said A. Tenanbaum shall build and maintain free of cost to the city or -public, if the remaining part of said street, shall be paved or macadamized during the continuance of this grant, a pavement of like character or material between the rails and two feet on each outside thereof; that said switch shall be maintained that the top of the rails of same shall be on a level with the grade of the street as is now or may be herea er es— --- tablished, and shall be maintained so as not to interfere with any waterway or flow of same, and the city shall have the right to alter said grade at its pleasure; that said A. Tenlaabaum shall hold the city harmless from damages of any kind occassioned by maintaining said switch, or the use of the same. Section 3. That the said A. Tenanbaum shall wthib twenty (20) days after the passage of this ordinance signify its 2. acceptance of the terms and provisions thereof by proper certificate and endorsement on the record thereof. That all rights herein granted shall cease and determine on and after ten (10) years from the date of passage hereof, and at that time the said, A.Tenanbaum, his successors or assigns, shall remove said switch at Xt a or their own expense.
