AN ORDINANCE ANNEXING A CERTAIN PORTION OF THE CITY OF LITTLE ROCK, ARKANSAS, TO CURB AND GUTTER IMPROVEMENT DISTRICT N0.474 OF THE CITY OF LITTLE ROCK, ARKANSAS. e WHEREAS, persons claiming to be a majority in value of the owners of real property within the territory hereinafter described, which property adjoins vement District No. 474. of the City of Little Rock Arkansan , te: created and existing improvement district in said city, desire to be added to and included in said improvement district and have filed a petition with the City Council of the City of Little Rock, Arkansas, praying that said territory be annexed to said improvement district, have designated the nature of the improvement to be undertaken and have described the territory to be annexed; and, WHEREAS, the City Council has directed the City Clerk to publish for two weeks in some newspaper issued and having a bona fide general circulation in Pulaski County, a notice calling upon the property owners within said territory to appear before this council on March 11, 1929 and show cause for or against such annexation; and, WEEREAS, such notice has been duly published, and at the time fixed in said notice for the hearing to determine whether those signing said petition constitute the necessary majority in value of the owners of real property, said hearing was continued and postponed to April g, 1929, at which time this council denied said petition, and held that it did not contain a majority in value; whereupon, suit was brought by landowners in the Chancery Court of Pulaski County, Arkansas to review said findings and action of this council in so denying said petition; and, whereas, an order and decree of said court was rendered ordering_ tie council to proceed with organization of said annex by passing a proper ordinance finding and declaring-atha.t a majority in value of the owners of real property in the territory sought to be annexed have signed said petition, and annexing and making said territory a part of said district; and, WHEREAS, this council has heard all persons who desire to be heard upon the question of whether the signers of said petition constitute such a majority. NOW, THEREFORE, Be it Ordained by the City Council of the City of Little Rock, Arkansas; Section 1. That this council has ascertained that the signers of the petit;;on to annex the property hereinafter described to Curb and Gutter Improvement District No. 474 of the City of Little Rock, Arkansas, do constitute a majority in value of the owners of real property within the territory sought to be annexed; that said petition for the annexation of said territory is in due form and properly signed by a majority of the owners of real property as required by law. Section 2. That Lots 1, 2, 3, 10, 11, and 12, in Block 10; Lots 4 to 9, 3nclus�ve, in Block 11; Lots 4 to 9, inclusive, in Block 19; Lots 1, 2, 3, 10, 11, 4* dock 19* Lots q to 9 inclusive in Block 25 Lots 1 2 3,_10- 11 and 12, in Block 24; All in Newton's Addition to the Town of Pulaski Heights (now annexed to the City of Little Rock, Arkansas, but name of Addition not changed), be and the same is hereby added to and annexed to Curb and Gutter Improvement District No. 474 of the City of Little Rock, Arkansas, and the commissioners of said district shall proceed to make the improvements petitioned for by draining, curbing, and guttering Harrison Street from Prospect Avenue to "U" Street, insuch manner and with such materials as the commissioners of said district shall determine to be for the best interests of the district, the improvements to be of the same general character as that in the original district No. 474. Section 3. That said annexed territory shall be known as Annex No. 1 to Curb and Gutter Improvement District No. 474 of the City of Little Rock, Arkansas. s � A 4 Section 4. That the Commissioners shall make the assessment of benefits for said, improvements on the lots, blocks or parcels of real property in the territory herein annexed on the same basis as if said territory were included in t%re original district, and shall file said assessments with the city clerk. Section 5. That.all ordinances or parts of ordinances in conflict herewith are hereby repealed and this ordinance shall take effect and be in force from and after its passage, and the city clerk is hereby ordered within t trthe passage of this ordinance to publish the same in some ;,er}tiublished in the City of Little Rock, Arkansas, for one insertion.
