HomeMy WebLinkAbout4421a ORD IxUCE N0. 4421. AN ORDINANCE GRANTING A FRANCHISE TO LOUIS B. SIEGEL TO OPERATL AND MAINTAIN THE CITY D W 9 AND FOR OTHER PURPOSES. ROCK: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE Section 1. That for the purpose of maintaining and op- erating the city dump located on all of lots 39 9, 10 and 11, and all of lots 4, 5, 6, 7 and 81 except the South SO feet thereof,, in Fletcher & Clarkts sub - division of Block B, of Russell's Addi- tion to the City of Little Rock, and for salvaging such garbage, refuse, trash, etc., delivered at said dump, that may be of use or value to said Louis B. Siegel, the exclusive right to maintain and operate said dump is hereby granted to the said Siegel for the period of one year from the date of the acceptance of this ordinance upon the margin of the record thereof, in the office of the City Clerk of the City of Little Rock. Section 2. To enable the said Louis B. Siegel to pro- perly maintain and operate said dump, and to receive thereat all garbage, refuse, trash, etc., that may be delivered thereto, a lease -hold interest is hereby granted to hiip in the aforesaid property for a period of one year from the date of the acceptance of this ordinance upon the margin of the record thereof in the office of the said city clerk. Section 3• The rights and privileges above granted are subject to, and expressly granted upon the following conditions and stipulations, to wits r #2. First: The said Siegel shall have exclusive possession of the real property aforesaid and shall have the exclusive franchise to maintain and operate said dump, receiving thereat garbage, refuse, trash, etc., that may be delivered thereto, for the period of time aforesaid, and shall further have the exclusive privilege to remove and salvage from such refuse, garbage, trash, etc., delivered at said dump, such cast away articles as may be of value to him. Second: In consideration for this franchise, said Siegel shall pay to the City of Little Rock the sum of $605.00 per annum, payable in monthly installments, each install- went to be paid each month in advance. Third: Said Siegel shall bear all expenses in connection with the maintenance and up -keep of said dump, and no charge shall be made by him for depositing or dumping garbage, refuse, trash, etc., thereat, and he shall maintain said dump in such manner as to meet the requirements of the city health and sanitation departments. Fourth: The city reserves the right, however, to sell the property hereinbefore described, now used for the dump, and to remove the dump to some other location, and in the event of the sale or removal of said dump, the said Siegelts right to possession or lease -hold interest in said real estate, shall immediately cease and determine, and the right of posses- sion and a lease -hold interest in the real estate constituting the new dump, shall immediately attach thereto upon the location of said new dump. t #3• Section 4. A.11 ordinances and parts of ordinances in conflict herewith are hereby repealed and this ordinance shall take effect and be in force from and after its passage, and its acceptance by the grantee herein, upon the margin of the record hereof, in the office of the city clerk.
