AN ORDINANCE AUTHORIZING THE CHICAGO, ROCK ISLAND & PACIFIC RAILWAY COMPANY, ITS SUCCESSORS AND ASSIGNS, TO CHANGE THE LOCATION OF SIDEWALK ON THE SOUTH SIDE OF BLOCK THREE (3) , RECTORTOWNT ADDITION?, UPOY CERTAIN CONTDITION'S. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: WHEREAS, Third Street, extending from Byrd Street East 213.2 feet on the South side of Block Three (3) Rectortown Addition, is only thirty -six (36) feet in width from curb to curb, and The Chi- & Pacific.Raiway Company, hereinafter called the Railway Company, its successors and assigns, desires to pro- vide an additional space for the purpose of affording ingress and egress to and from its passenger station and additional parking space for automobiles and other vehicles, by devoting to such use a strip of land off the South side of Block Three (3),. Rectortown Addition; now, therefore, 1� Section 1. The Railway Company is, authorized to remove the present 213.2 feet of sidewllk on the South side of Block Three (3), Rectortown Addition, and to provide for the use of said sidewalk as apart of Third Straet and of the parking space, or area way, to be "de'd by said Company off the South side of said bleckt Section 2. This grant is upon condition that the Railway Company will provide a new sidewalk six feet in width, and pave same with concrete extending East 213.2 feet from Byrd Street, North of the area way or parking space so to be provided. Section 3. It is agreed on the part of the City that the use by the public of said area way or parking space, provided by the Railway Company forth of the curb line of Third Street as now located, shall be permissive only, and the said Railway Company, its successors and assigns, shall at all times have the right to exclude Ow- vubli.e therefrom, and, to take possession thereof for its own priv*e purposes, provided that before doing so, it shall reconstruct the 2132 feet of sidewalk and curb across the South side of Block Three- (3), Rectortown Addition, as the same is now located, therebyrostoring Third Street to its present width of Thirty -six (36) feet from curb t o curb. section 4.
