ORDINANCE NO. 4292.
AN ORDINANCE GRANTING TO THE DONAGHEY MAIN AND MARKHAM REALTY
CO., THEIR ASSIGNEES AND SUCCESSORS THE RIGHT TO EXCAVATE
UNDER THE SIDEWALK ON MAIN AND MARKHAM STREETS ADJACENT TO
THE WEST SIXTY -NINE FEET OF LOTS 19 2 AND 3 OF BLOCK 2
ORIGINAL CITY OF LITTLE ROCK AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE
ROCK:
SECTION I. That the Donaghey Main and Markham Realty
Co., being the owners of the west sixty -nine (69) feet of
Lots 1, 2 and 3, Block 2 in the original City of Little
Rook, which property is situated at the south -east corner.
of Main and Markham Streets in said City and said Company
now being engaged in excavating said lots for the purpose
of erecting thereon a building, and their assigness and
successors, be and are hereby granted permit to excavate
under the sidewalk adjacent to aaid property, said ex-
cavation to extend six feet beyond North and West property
lines.
SECTION 2. That the excavation hereby permitted,
shall extend on both Main and East Markham Streets and
the right is hereby granted to maintain therein super-
structure and basement of said proposed building for a
period of ninety -nine (99) years.
SECTION 3. That the Board of Public Affairs of the
City of Little Rock is hereby authorized and instructed
to enter into and complete a lease for the use of the
above mentioned space by the Donaghey Main and Markham
ltlpalty Oo. for a period of ninety - nine years at one dollar
($1.00) per year.
SECTION 4. This ordinance is to take effect and be
in force from and after its passage.
