HomeMy WebLinkAbout4187as ORDINANCE NO. 4187- r� AN ORDINANCE VACATING AND ABANDONING THAT PART OF RICE STREET LYING BETWEEN THE NORTH PROPERTY LINE OF WEST CAPITOL AVENUE AND TEE SOUTH LINE OF CAPITOL VIEW ADDITION. Whereaa, in the platting of Capitol View Addition and of Capitol Hill Extension Addition, there occurred an offset in Rice Street so that it is not a continuous thorough- fare, and cannot be used as such; and Whereas Grady Garms owns the East 130 feet of Lot Seven (7) of Block Twenty—nine (29) of Capitol Hill Extension Addition, which lies across Rice Street which is paved from West Markham Street down to the north line of the property owned by the said Grady Garms, which property of the said Grady Garms also abuts on that part of Rice Street as platted in Capitol Hill Extension Addition lying between the north line of West Capitol Avenue and the south line of Capitol Viers Addition, and Whereas the said Grady Garms has dedicated sufficient property to the City of Little Rook to straighten 'Rice Street and eliminate the offset hereinabove described THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKAMAS: Section 1• This Council doth now find that the City of Little Rock has a inhabitants as shown as now platted, Rice Street has - an offset View Addition and Ca- population of more than fifteen thousand by the last Federal census; and that, Street running south from West Markham on the boundary line between pitol Hill Extension Addition, which offset is so great that it prevents the street from being a< through avenue of traffic; and this Council doth further find that the said Grady Garms has dedicated to the City of Little Rock sufficient property to straighten Rice Street to the 1 -2- *4w� north line of West Capitol Avenue and to eliminate the offset hereinabove described. Section 2• The Gouneil Both find that the said Grady Garms has presented to this Council his petition pr ying that that pert of Rice Street lying.,between the north line of West Capitol Avenue and the south line of Capitol View Addition be abandoned as a city street, and this Council by resolution adopted on the day of May, 1927, directed the City Clerk to give notice by pub- lication once a week for two weeks in soma newspaper pub- lished in Pulaski County, Arka nsa s, advising the property owners that on this day this Council will hear the petition and determine whether the property should be abandoned as a street, and whether all abutting property owners and other persons directly interested had consented to such abandonment. This Council doth find that said notice has been duly publish- ed as required by law, and tbat this is the time and place fixed in said notice for this hearing, and after hearing all abutting property owners and other persons directly interested, this Council loth determine that the part of Rice Street herein - above described should be abandoned as a street, and that all abutting property owners and other persons directly interested have consented[ to such abandonment; and that the abandonment is to the best interest of the citizens of the City of Little Roak and necessary for publie convenience and necessity. Section 3� That Rio* Street fr= the herth property line of West Capitol lv *nroa to the south property line e Capitol View Addition be, and the same is hereby vacated and abandoned as a street. E 5im Section 4• That the Mayor and City Clerk are hereby authorized and directed to execute a deed of conveyance oon- veying all right, title and interest of the city in and to that part of Rine Street described in section three hereof to the said Grady Garms .
