ORDINANCE NO. 4182.
AN ORDINANCE GRANTING TO ADAPT C. PENZEL THE RIGHT TO CONSTRUCT
AND laINTAIN TIC' FOLLOWING LINE' OF SY,TER: BE'GINNIT�JG I19 THE CENTER
OF BLOCK 12, GARLAND ADDITION TO THE CITY OF LITTLE ROCK, THENCE
NORTH TO THE ARKANSAS RIVER, AND FOR OTHER PURPOSES:
BE IT ORDAI E BY THE" CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. That the right and privilege are hereby granted
to Adam C. Fenzel, his heirs and assigns, to construct and maintain
at his own expense, a certain line of sewer, extending from the
center of Block 12, Garland Addition to the City of Little Rock,
Arkansas, to the Arkansas River, which is in a northerly direction
from the point of beginning. It is provided, however, that said
sewer shall accomodate all houses erected on Block 12 of Garland
Addition, and it shall be constructed according to the plans and
specifications as approved by the Superintendent of Public Works
and the City Health Officer of Little Rock, and shall be large
enough and sufficient in size to carry at least ten per cent more
than the sewage of said Block 12, Garland Addition to Little Rock.
Section 2. In consideration of Adam C. Fenzel advancing the
funds necessary for the construction of said sewer and maintenance
of same, he is hereby granted the exclusive control of the sewer
main herein authorized for and during the period provided by this
ordinance, and he is authorized to permit or prevent any connections
! thereto by any person, persons, corporation or firm, except upon
the terms and conditions specified in this ordinance.
Section 3. That the said Adam C. Fenzel shall permit all
property owners to connect with said sewer upon the payment of the
sum of ;'25.00, by the persons or person desiring to make connection,
to the City Collector.
Section 4. As soon as Adam C. Penzel receives a sum equal
to the cost of construction plus eight per cent, then said sewer
shall be turned over to the City of Little Rock. Provided, however,
that said sewer shall become the property of the City of Little
Rock after the expiration of five years, regardless of whether or
not Adam C. Penzel has been reimbursed for the cost of construction.
Section 5. The City Collector is hereby designated as
collectorof the sum or sums provided in Section 3 hereof for each
connection, and he shall retain three per cent for the use and
benefit of the City of Little Rock, and the balance shall be paid
to Adams C. Penzel, his heirs or assigns.
Section 6. The said Adara -,C. Penzel shall file his written
acceptance of the terms of this ordinance within thirty days from
the date of passage, and upon his failure to do so, the ordinance
shall be of no effect.
Section 7. This ordinance shall take effect and be in force
from and after the date of its passage.
