/nAND OR DINANCE GRANTING TO I. W. MCGILL THE RIGHT TO CONSTRUCT
MAINTAIN THE FOLLOWING LINE OF SEWER: BEGINNING IN CENTER
OF ALLEY BETWEEN HARRISON AND TYLER STREETS, WHICH POINT OF
BEGINNING IS IN THE REAR OF LOT SEVENTEEN (17), BLOCK TWO (2)0
ENGLEWOOD ADDITION TO THE CITY OF LITTLE ROCK, THENCE IN A
SOUTHEASTERLY DIRECTION 375 FEET TO THE MCGEHEE SEWER, AND FOR
OTHER PURPOSES:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Section 1. That the right and privilege aw hereby granted
to I. W. McGill, his heirs and assigns, to construct and maintain
at his own expense, a certain line of sewer, extending from center
of alley between Harrison and Tyler Streets, which point of beginning
is in the rear of Lot 17, Block 2, Englewood Addition to the City
of Little Rock, Arkansas, thence running in a southeasterly direction
375 feet to point of connection with the McGehee Sewer. It is
provided, however, that said sewer shall be constructed according
to the plans and specifications as approved by the Superintendent
of Public Works of the City of Little Rock, and shall be large
' enough and sufficient to `carry at least ten per cent more than
the sewerage of said addition.
Section 2. In consideration of I. W. McGill advancing the
funds necessary for the construction of said sewer and maintenance
of same, he is hereby granted the exclusive control of the sewer
main herein authorized, for and during the period provided by this
ordinance, and he is authorized to permit or prevent any connection
therewith by any person, persons, corporation or firm, except upon
the terms and conditions specified in this ordinance.
Section 3. That the said I. W. McGill shall permit all
property owners to connect with said sewer upon the ayment to him
of the sum of $50.00, and the payment of the sum of 25.00 to
McGehee, owner of the McGehee Sewer to which the herein
authorized sewer is to be connected.
Section 4. As soon as I. W. McGill receives a sum equal to
$he cost of construction pllts eight per cent, then said sewer shall
be turned over to the City of Little Rock. Provided, however, that
said sewer shall be turned ovar to and become the property of the
city after the expiration of five years, regardless of whether or
not I. W. McGill has been reimbursed for the cost of construction
plus eight per cent.
Section 5. The City Collector is hereby designated as a
collector for the parties mentioned to whom all moneys for connection
shall be paid and for the benefit and use of the city, shall receive
three per cent of all amounts collected talk pay the balance of
all collections to I. W. McGill and Ben C. McGehee, as provided
in section three of this ordinance.
Section 6. The said I. W. McGill and Ben C. McGehee
shall file their written acceptance of the terms of this ordinance
within thirty from the date of passage, and upon their failure to
do so, the ordinance shall be of no effect.
Section 7. This ordinance shall take effect and be in force
from and after its passage.
