owners of real property within the territory hereinafter described,

which property adjoins Street Improve:::ent District No. 439 of the

Tent district in said city, and is contiguous thereto, desire to
be added to and included in said improvement district and have
filed a petition ,vvrith the city council of the City of Little Rock,
Arkansas praying that said territory be annexed to said improve-

'Whereas the city council has directed the city clerk to
publish for two weeks in soi,,ie newspaper issued and havinv, general
circulation in Pulaski County a notice callin- u0on the property

day and show cause for or against such annexation; and,
Whereas such notice has been duly published and this is the
time for the hearing to determine whether t1.ose signing; said
petition constitute the majority in value of the oi,ners of real
property in said territory; and,
'i'rereas this council has heard all persons who desire to be
heard upon the question of whether the signers of said petition
constitute such a majority; and,
Whereas this council has ascertained that said signers do
ponatitute such majority as shown by both the record of deeds
and by actual ownership and that the said property embraced in
said petition is contiguous to Street Iariprove.aent District No.
439 of the City of Little Rock, -�,r?Lansas;
Now, therefore, be it ordained by the city council of the
City of Little =dock, "- r';ansas :
Section 1. That this city council has ascertained that the signers
of the petition to annex the property hereinafter described to
Street IIiproveiiient District Ito. 439 of ti_e City of Little Rock,
Arkansas do constitute a majority in value of the owners of real

property within the territory sought to be annexed; that said
petition is in due form and properly signed by a majority of the
owners of real property as required by law.
Section 2. That all real property described as follows,
to -wit:
Lots Ten (10) Eleven (11), and Twelve (12), Block One (1),

of Pulaski and State of Krkansas,
be and the same is hereby added to and annexed to Street Improve -
ment District No. x'39 of the City of Little Rock, Arkansas, and
the commissioners of said district shall proceed to make the
improvements petitioned for by repaving, gradinE, repairing,
curbing, gutterin:, and draining East .arkham Street in the City
of Little Rock, Arkansas from its intersection with the west
property line of Commerce Street east to its i�:�terselzon with
the west property line of Rector Avenue, and Eradin6, ---- -- paving,
curbing, guttering, and drai nine; that part of Co,:itaerce Street
lying north of East 1arkham Street, comuonly designated as Horth
Commerce Street, from its intersec ion with East 1 aikham Street
to a point one hundred forty feet north of the north side of
East Markham Street and grading, paving, curbing, guttering, and
draining that part of Sherman Street lying; north of East Markham
Street, commonly designated as North Sherman Street, to a point
one hundred twenty -five feet north of the north side of East
Idarkham Street and buildin8 such retaining walls as may be necessary,
except that part of East Markham Street which may be paved by the
Street Car Company; said improvement to be done in such -_;canner as
the Commissioners of Street Improvement district No. 439 may de-
termine to be for the best interest of the district so annexed
and the inprove-snt to be of such aterial as the Commissioners
shall determine to be for the best interest of the district except
that the surfacing and re- surfacing of said stye is shall be done

Section 3. That said territory hereby annexed shall be
known as Annex No. 1 to Street Iiaprovei.ient District No. 439 of
the City of Little Rock, Arkansas and become a part thereof as
if originally embraced within the district.

Section 5. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed, and this ordinance shall
take effect and be in force from and after its passage, and the
city clerk is hereby ordered within twenty days after the passage
of this ordinance to publish the same in some newspaper published
in the City of Little Rock for one insertion.
