HomeMy WebLinkAbout40224 �1 40", v ORDINANCE NO. 4-022_„ AN ORDINANCE ANNEXING A CERTAIN PORTION, HEREINAFTER DESCRIBED, OF THE CITY OF LITTLE ROCK, ARKANSAS, TO CURB AND GUTTER WROQEMM DISTRICT No. 429 OF LITTLE ROCK, ARKANSAS. wHEREAS, persons claiming to be a majority in value of the owners of real property within the territory hereinafter described, which property adjoins Curb and Gutter Improvement District No. 429 of Little Rook, Arkansas, a duly created and existing improvement district in said city, desire to be added to and inoluded in said improvement district, and have filed a petition with the City Council of the City of Little Rook, Arkansas, praying that said territory be annexed to said improvement district and have designated the nature of the im- provements to be undertaken, and have described the territory to be annexed, and WHEREAS, the 4ity Council has directed the City Clerk to publish for two weeks in some newspaper issued and having a general circulation in Pulaski County, a notice calling upon the property owners within said territory to appear before this Council on this day and show cause for or against suoh annexation, and WHEREAS, such notioe has been duly published and this is the time fixed in said notice for the hearing to determine whether those signing said petition constitute a majority in value of the owners of real property in said territory, and WHEREAS, this Council has heard all persons who desire to be heard upon the question of whether the signers of said petition constitute a majority in value of the owners of real property within said territory sought to be annexed; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That this Counoil has ascertained that the signers of the petition to annex the property hereinafter described to Curb and Gutter Improvement District No. 429 of the City of Little Book, Arkansas, constitute a majority in value of the owners of real property within the territory sought to be annexed, and that said petition for 'the annexation of said territory is in due form and properly signed by a majority of the owners of real property as required by law. SECTION 2. That Lots 1 to 6, inclusive, of Block 2 of Central Heights Addition and Lots 7 to 12, inclusive, of Block 8 of Kimball and Bodemann's Addition of the City of Little Bock, Pulaski County, Arkansas, be, and they are hereby added to and annexed to Curb and Uutter Improve- ment District No. 429 of Little Rook, and are a part of said improvement district, and the commissioners of said district shall proceed to make the improvements petitioned for by doing the necessary draining, curbing, - grading and gutteringin such manner and with such materials as the commissioners of said district shall determine to be for the best interests of the territory hereby annexed to said Curb and Gutter Improvement District No. 429 on Valentine Street from the south line of West Seventh Street to the north line of West Eighth Street; that such annexed territory shall be known as the Valentine Street Annex to Curb and Butter Improvement District No. 429 of Little Rook, Arkansas. SECTION 3. That the commissioners shall make the assessment of benefits for said improvements on the lots in the territory hereby annexed on the same basis as if said territory had been included in the original district and shall file said assessments with the Vity Clerk, SECTION 4. That all ordinances in conflict herewith are hereby repealed and this ordinance shall take effect and be in force from end after its passage and the City Clerk is hereby ordered within 20 days after the passage of this ordinance to publish same in some newspaper published in the City of Little Rook for one insertion.
