HomeMy WebLinkAbout3913ORDIN00.0 No. 3513 • An Ordinance to Regulate the Traffic and the Use of the Streets of the City of Little Rock and For Other Purposes, Be It Ordained by the City Council of the City of Little Rook: Section 1. That the use of the streets of the City of Little Rook by the rules andhregulationsesetlout of description shall be subject sections of this to the rules g ordinance. Section 2. Definition of Terms. Street: Any road used as a public thoroughfare, Sidewalk: That part of the street for the use of pedestrians. Roadway: That part of a street for the use of vehicles. Cross =walk: That pant of a roadway marked or understood upon :which pedestrians should (Toss. Curb: That lateral boundaries of a roadway, Vi marked or understood. Hoz se: Any saddle or harness animal, Vehi31e: Any conveyance on wheels except street cars. Driver: Any person in control of a vehiole or animal. Person: Shall include firm or corpora. tion, Congested Distxiot: Markham to Ninth on Scott, Bridge to Tenth on Main, Markham to Ninth on Louisiana and Markham to Ninth on Centers, This district shall be inclusive and shall embrace all east and west streets in the district. Section 3, Authority. Pedestrians, and drivers of any vehicles including operators of street oars, shall at all times comply with the directions of any m amber of the Police Department with regard to stopping, starting, taking up or letting out passengers, loading or unloading merohandise, or passing along or across any street, Section 4, 3lectrio Signals. Drivers of vehicles and operators of street oars shall not pass the property line on approaching inter- sections where electric signals are in operation except when the green light is shown in their direction„ Section 5, Meeting. The driver of a vehicle meeting another shall pass to the rights Section 6. Overtaking. The driver of a v3hicle overtaking another vehicle shall pass to the left and shall not pull over to the right I` until twenty feet ahead of the overtaken vehicle. Section 7. Keep to Right, The drivers of all vehicles shall keep as near the right hand curb as practicable, The drivers of heavily W loaded or slow moving vehicles shall keep to the extreme right. Section 8, Reckless Driving, It shall be ualavful for any person to drive or ride through or upon the streets or al l Ws of this city in a oar ele ss or xeokless manner, Section 9. Passing Street Car. The driver of a vehicle passing a street car shall do so on the right side theoreoST s _ . Section 10e Stop Back of Str3et Car Loading or Unloading Passen- gers. The driver of a vehicle overtaking a street oar Which has stopped > or is stopping to load or unload passengers, shall not approach said vv /lf oar closer than ton feet and shall not pass said street car until both doors are closed or it proceeds, provided this shall not apply in th9 Safety Zone Distriote Section 11• Turning, It shall be unlawful to turn any vehicle around in any street except at street intersections, Section 12, Turning to Right, The driver of a vehicle turning into a street to the right shall keep as near the right hand curb as practiea.. blee -240 Section 13. Turning to Left. The driver of a vehiate turning into a street to the left shall pass around the center of the Intel section of the two streets, but shall not turn to the right just before turning to the left* Section 14, Certain Left -hand Turns Prohibited, It shall be unlawful to make a left -hand turn with arty vehicle so as to change its course at or upon the following intersections: Second and Main, Third and Main, Fourth and Main, Capitol Avenue and ?fain, Sixth and Mains Seventh and Main, Eighth and Fain, and Ninth and Main* oeot ion 15. Turning Into and From an Alley. Drivers of vehicles shall give warning by holding out diagonally downward the left arm before turning into an alley or passing from the street to private property, On coming out of an alley or driving into a street from private property they shall come to a full stop back of the property line and be sure that the way is clear. Section 16. Turning Into Filling or Service Stations. Drivers of vehicles may turn to the left into filling or service stations by giv- ing warning by holding out diagonally downward the left arm* Section 17. :Boulevards. The following streets shall be boulevards: Broadway from Markham to Twenty - Fourth, Fourteenth Street from College to Park Avenue, Battery from Seventh Street to Wright Avenues and West Third Street beginning at Brosjdwikv and going west across the viaduct turning north at Summit Avenue and continuing northwest into Markham Street at Barton Street and thence west to Ridgeway* Section 189 Entering a Boulevardb The drivers of all vehicles except fire apparatus, vehicles of the Police Department and ambulances on emergency service, shell when approaching a boulevard bri ' their vehicles to a Bill stop b fore entering or crossing same*%,;. .� Seotion!190 Processions. No person shall drive or ride any vehi(As or animal through a procession except with permission of a police offices Section 20. Funeral Processions* It shall be unlawful for any Person to drive any animals vehicle or any street oar through or across a funeral procession; provided, this section shall not apply to fire apparatus or police vehicles and ambulances making emergency calls. Section 210 Right of Way. The drivers of vehicles approaching a street intersection at approximately the same time shell give the right Of way to the vehicle approaching from the right* The driver to the left shall have the right of way over the driver of the second vehicle approaching from the right, Section 22* Certain Vehicles have Right of Way* Vehicles of the Fire and Police Departments shall have the right of way in any street and through any procession when in the regular course of their duty, and ambulances when on emergency calls* Upon the approach of any appar� atus of the Fire Department, operators of street oars shall stop their cars, and all drivers of vehicles shall drive same as near as practi- oable to the right hand curb and stop until the apparatus has passed when they both may proceed, Section 23. Traffic at Street Intereeotions. The drivers of all vehicles and operators of street oars approaching a street intersection where a traffic officar is stationed, shall proceed to dross such inter- section only upon a signal oz direction of such traffic officer, given by voice, hand, whistle, or otherwise. Section 24, Police Traffic, Signals* Police traffic signals indi- cated by whistle are as follows: One blast, north and south traffic Proceeds east and west traffic stop behind the# property line* Two blasts, east and west traffic proceed, north and south traffic stop behind the property line, -3- Section 25. Signals on Slowing, Stopping or Turnings The drivers of all vehicles shall signal by hand or other effective method, before slowing, stopping or turning as follows: A left hand turn shall be indicated by extending the arm downward, A right hand turn shall be indicated by extending the arm diagonally upward. A stop or slowing down shall be indicated by extending the arm horizontally. The driver of a vehicle desiring to leave the curb shall give warning by extending the left arm horizontally. Section 26. Speed, General. No person shall drive a motor vehicle or motorcycle upon any public highway in this city at a greater speed than is reasonable or proper, having regard to the traffic and the use of the way, or so as to endanger the life or limb or injure the prop- erty of any person. If the rate of speed of any motor vehicle or motorcycle operated upon any public highway in the city exceeds fifteen (15) miles an hour fox a distance of one - eighth of a mile, such rate of speed shall be prima facie evidence that the person operating suoh vehicle is running at a rate of speed greater than is reasonable and proper, having regard to the traffic and the use of the way, or as to endanger the life or limb or injure the property of arV person. Section 27. Peddling and Advertising Vehicles., It shall be unlaw- ful for drivers or operators of peddling vehicles to transact business,, and drivers of advertising vehicles to park or travel slower than six miles an hour in the Congested District, except when retarded by traffic ahead or in obedience to a traffic signals Seotion 28s Speed Around Curves or At Street Intersections. If the rate of speed of a motor vehicle or motorgycle, being operated on the streets of this pity, in going around a corner or curve or in pass- ing a street interseotion where the operator "s view of the road traffic is obstructed, exceeds six (6) miles an hour, such rate of speed shall be prima facie evidence that the person operating such motor vehicle or motorcycle is running at a rate of speed greater than is reasonable, having regard to the traffic and the use of the way, or so as to endan- ger the life or limb or injure the property of any person* Section 29. Speed Through Parks. No person shall drive any vehicle or ride any animal in arT park at a greater speed than a rate of fifteen (15) miles an hour. Section 309 Speed Through Quiet Zones and Passing Schools, No person shall drive any vehicle through any quiet zone or past any school faster than ten miles an hour, the lattor prohibition to be in force during any part of the school year from 7 :30 A,11. to 5 PQM, Section 31, Safety Zones, The Safety Zone District shall include Fain Street from the foot of the Main Street Bridge to the south prop. erty line of Ninth Street ait West Capitol Avenue from Main Street to the alley between Main and Louisiana Streets. The safety zones shall be plainly marked under the direction of the Police Departments They shall be located at the usual stopping places of street oars and are for the protection of those entering or leaving the oars* Section 32, Driving Over Safety Zones Prohibited. It shell be unlawful for any person to drive or operate any vehicle over, through or across any safety zone. Section 33. Speed Past Safety Zones. Drivers of vehicles shall drive to the right of safety zones but shall not do so at a greater speed than six miles an hour while a street car is standing at same and the driver must have his car under absolute control so that it may be stopped immediately in case of an emergenoyq Section 340 Parking Prohibited on Certain Streets. Section 36. Park Within One Foot of Curb« The drivers of all ve- hicles shall pw k them with the right front wheel and the right rear wheel not more than one foot from the curb, except where angle parking is allowed$ 5eotion 37. Keep Cross -Walks Clear* The drivers of all vehi apes shall park them back of the property line and shall not obstruct any part of any cross -walk* Section 38, Double Parking Prohibited, Drivers of vehicles shall not perk or stop their vehicles where there is a vehicle between it and the curb or room for once. This shall apply whether the vehicle is oocu- pied by the driver or not, It shall be unlawful to stop on the street except as provided in Section 36 except to obey a traffic signal or wbsn blocked by traffic ahead. Section 39, Parking With Motor Running Prohibited. It shall be unlawful for any driver of any vehicle to park or stop his oar and leave the motor running unless it be occupied by some competent person capable of operating it. Section 40o Parking Near Fire Hydrants Prohibited,, It shall be unlawful for any driver of any vehicle to park or allow to remain standing any vehicle within four feet of a fire hydrant. Section 41e Parking At Safety Zones. It shall be unlawful for a driver of any vehicle to park same within* ten feet of a safety zone or between a safety zone and the curb* Section 42. Parking In Alleys Prohibited. It shall be unlawful for any person to park any vehicle in any alley except commercial oars or wagons for the purpose of loading and unloading and for no longer period than is actually necessary to load or unload. No vehicle shall be parked or shall remain standing in front of an alley, Seotion 43. Parking on Sidewalks Prohibited. It shall be unlawful for the driver of any vehicle to park same on any sidewalk or so as to block or obstruct any private driveway. Section 44o Parking Near Construction Work Prohibited. It shell be unlawful for the driver of any vehicle to park same or allow it to remain standing for a longer period then three minutes, except for the purpose of loading or unloading, adjacent to any portion of a street temporarily narrowed for the purpose of storing maohin ar y or material used in connec- tion with the erection of a building or improvement, or park said vehicle on the other side of such streest. Section 45. Parking In Front of Churches, Hotels, Etc* It shall be Unlawful for any driver of any vehicle to park or allow same to remain standing in front of any church when services are being conducted, and theatre or picture show while shows are in progress, or in front of any hotel of fifty or more rooms oapaoity, except momentarily for the purpose of loading or unloading passengers, A space of thirty feet in front of entrance shall be marked for this purpose by the Police Department and shall be kept free of vehi cles, Section 46s Hairpin or Reverse Turns+ It shall be unlawful for any driver of any vehicle to make a reverse or hairpin turn in the Congested District and on Hain Street from Tenth to Fifteenth inclusive. -5- Section 47* Parking in Congmoxed'�hantonethouriindthe Congestsbe unlawful to park any vehicle for District on week days from 7 A *M. to 6 P*M* I Section 48. Parking Cars For Hire on Streets Prohibited* No person shall park or cause to be parked any jitney bus, taxicab or other vehiole used for hire upon any of the streets or alleys of this city except for the purposd of loading or unloading passengers and such period shall be limited in each case to ten minutes. Section 52* Street Cleaning Hours* No one shall park any vehicle in the Congested District between 2 A.M, and 6 AeM• T Section 53* Beggars, Sidewalk Peddlers and Street Oxatorse It shall be unlawful for any beggars sidewalk peddler or street orator to operate between the River and Tenth Street and between Cumberland and Bxoadwsy inolusiv e's Section 54o Speed of Ambulam es and Physicians on Emergency Runs* Ambulances and physicians on emergency runs will be allowed a speed of twenty -five miles per hour* Section 55, Post Office Parking*: It sha11 be unlawful for any one to park a vehicle for longor than tvr minutes from 7 A &M. to 7 Rom, on week days on the north side of Vest Second Street between Center Street and Spring Streets and on the east side of Spring Street and the west side of Center Street from Second Street to the all (V to the north of the Post Office Building. Section 56s, Parking Under Main Street Bridge* Parking shall be r allowed under the Main Street Bridge in such a manner as not to block the traffic through the opening* Section 57. Lights on trotor Driven Vehicles. It shall be ual awful for arV automobile, trunk or other motor driven vehicle except motorcycles operated upon the streets or alleys of the city after the hour of sunset before sunup that is not equipped with and has in operation two fron%tJB ights plainly visible at a distance of three hundred feet; provided section shall not apply to trucks equ�pped with one light in the esnter of the front part of the vehicle* - � k s-i° Section 58. Lights on Horse Drawn Vehiolese It shall be unlawful for any wagon, buggy or other horse drawn vehiol on the streets or alleys of the city between the hours of Sunset idupuaup that is not equipped with and has in operation a light plainly visible from the front and from the rear* Section 59* Rear Lights. It shall be unlawful to operate automo- biles, trucks, or other motor driven vehicles upon the streets or alleys of the city, between the hours of sunset and sunup except it be equipped -6- with and have in operation, one light plainly visible from the raRx showing red, and illuminating with a white light the license number so that it may be read at a distance of fifty feet. { "" Section 60, Motorcycle Lights. It axall be unlewtful to operate upon the streets or allqVs of the city between the hours of sunset and sunu any motorcycle except it be equipped with and hate in operation one Ton light plainly visible at a distance of three hundred feet and one 1igh plainly visible from the rear showing redo Section 61. Spotlights Prohibited. It shall be unlawful for any person to use or permit to bo used any spotlight upon any vehicle oper- ated upon the streets of this city, Section 62. Blinding Lights Prohibited. Blinding lights are hereby prohibited and evidence that they did momentarily blind any police offi- oer, approaching motorist or pedestrian shall be ample to convict the driver of the vehicle: using such lights in Municipal Court* Section 63. Trucks and Delivory Wagons. Drivers of tru3ks and delivery wagons are required to load and unload in the alley if there be one. They must not block traffic through the alley while so doing, The driver of vehicle second in position shall be fined if alley is blocked$ Section 64, Trucks and Delivery Wagons Backing to Curb. Where no alley delivery vehicles may load and unload parallel to the curb as provided for in Section 369 except at wholesale dealers' loading plat- forms outside of the Congested District, It shall be unlawful for the driver of a truck or delivery wagon to back to the curb except to load or unload an article of merchandise weighing one hundred °*" pounds or more; or for him to fail to move the vehicle as soon as the operation is completed* Section 65* Avoiding Arrest. It shall be unlawful for any person to turn off any lights on a motor vehicle for the purpose of avoiding arrest or identification. Section 66, License Tags, It shall be unlawful for any motor vehicle to be operated upon the streets or alleys of the city except it shall display regulation license tags of the State of Arkansas for the current year, both front and rear, and if it be a Little Rook car, the license tag of the city for the current year. Such numbers shall be displayed conspicuously in an upright position and in unobstructed view on the car to which they were issued and be kept reasonably clean,, Section 67* Warning Signals, It shall be unlawful to operate any motor driven vehicle upon the streets or alleys of the city except it be equipped with and in operating condition a horn, bell or other signal device not hereafter prohibited which shall be used only as a danger warning, It shall be unlawful to make with any horn, bell or other such device any unusual or unnecessary noise* Section 68, dign.al Devices Prohibited* It shall be unlawful for ary person to operate any vehicle upon or along the streets of this city using a siren whistle or whistle operated by exhaust gas except those operated by the Fire Department, Police Department or ambulances on emergency runs. Section 69. Brakes. It shall be unlawful for ary one to operate upon the streets or allgrs of this city any motor driven vehicle unless it be equipped with efficient brakes maintained in good working order# Section 70, Wflers Required. It shall be unlawful for any per- son to operate any motor vehicl a upon or along the streets of this city without a muffling device through which the exhaust gasses from the motor of said vehicle shall at all times pass while in operation, and the use Of open out -outs is prohibited in this city. 11 -7- Section 71. It shall be unlawful for any person to drive any upon the streets of this city while under the influence of intoxicating liquor or drugs. Section 804 Damage to Tires. Age Limit of Drivers. It shall be unlawful for any one under the age of fifteen years to operate a motor driven vehiole upon the streets or alleys of the city; and it shall b3 unlawful for the owner or custodian of any motor driven vehicle to allow any one under fifteen years of age to operate said vehicle on the streets or alleys of the city, Section 82, Closing Street. Whenever the Police Committee shall deem it advisable for the public safety or convenience, or to p-ravent the obstruction of az7 street during the time same is being used for any parade, to close such street or part thereof, temporarily, to vehicular traffic, the Chief of Police shall have the authority to do so* All persons operating or driving ary vehicle or animals shall cease to use such street upon the order or direction of the Chief of Police or police officer acting under his orders. Section 83. In Case of Accident. In case of an accident due to the operation of any vehicle, the dr,1ver of such vehicle shall stop immediately and render such assistanoo as possible, and before leaving the place of such accident shall give their true name, true address, -8- and if not the owner of said vehicles shall give the owner's true name anti true address, together with the registered number of such vehicle in case it is motor driven, to the person injured or whose property is damaged or any other persons who question him; and the driver of such vehicle shall immediately report the accident to the Police. Section 84. Pedestrians to Observe Traffic Rules. It sllall be un- lawful for pedestrians to disregard the traffic; signals of a police officer or of an electric signal, arld they shall not cross the street where traffic officers or electric signals are at work or in operation@ except when the signal is given for traffic to move in the direction toward vdhioh the pedestrian is crossing. Section 85, Pedestrians Crossing Street. It shall be unlawful for pedestrians to get on the roadway except when neoessary to cross and they shall cross the streets at right angles and at cross -walks only. Section 86. Pedestrians and Safety Zones. It shall be unlawful for pedestrians to enter safety zones except from the cross -walk _sM or stand on the street outside the limit of said zones. Where there is no safety zone established, it shall be unlawful for pedestrians to enter the street to wait for an approaching street car until said car is within two hundred feet or less of stopping pleas. Section 87. Pedestrians Alighting from Street Cars. It shall be unlawful for pedestrians alighting from a street oar to remain in the street or cross the street without first proceeding to the right hand curb.* Where safety zones exist the pedestrians may proceed to the right hand curb or wait in safety zone until oar has passed on and traffic signals allow them to cross. Section 88. Pedestrians Keep to the Right. It shall be unlawful for pedestrians to walk on the left side of sidewalks or stop in the middle of them when the sldewalk,s are crowded# Section 896 Bicycles. Riders to Conform to Traffic Rulos. Every person riding a bicycle upon the streets of this city shall conform to the traffic rules and regulations governing the operation of other vehicles upon the streets. It shall be unlawful for ary one to ride a bicycle on any sidewalk. Section 90o Bicycles. Lights and Bells Required. Every person riding a bicycle upon the streets of this city shall have such bicycle equipped with a light at night and a bell by day, the light to be attached to the front of the bicycle and the bell in some convenient plaoefor sounding as a warning only.* Section 91* BitVoles. Catching on Nfoving Vehicles* It shall be unlawful for arq person riding a bicycle to catch or grasp any street oar or vehicle which is moving along the streets of this oity. Section 92* Bicycles and Motorcyoles must Be Under Control. It shall be unlawful to ride any bicycle or motorcycle upon the streets of this city with the hands of the rider off the handlebars and the rider of a bicycle or motorcycle shall at all times keep such vehicle under complete control* Section 93, Hitching Horses. It shall be unlawful for aty person to leave any horse or other animal on the streets or all cVs of this city without securely hitching suoh horse or other animal* Section 94, Horses, Speed* No person shall ride or drive any har se on a street or alley in this city faster than an ordinary trot or pace, Section 95o -Electric Signals and Those of Traffic Officers* It shall be unlawful for the driver of any vehicle or any pedestrian to disregard the order of any traffic officer even though the signal of an electric signal may be opposite to the directions of the police offleer. 'L"M Section 96. Projecting Loads. It shall be unlawful to drive any vehicle so loaded that any material extends beyond two feet of the sides or eight feet of the rear of such vehicle unless a red light by night and a red flag by day is affixed to the projecting end of such material. Section 97. Trucks, Tractors, -ito. It shall be unlawful for any person to move or propel any truck, tractor, or other piece of machin- ery, having spiked tires or other than smooth tires, upon the streets or alleys of the city except under the direction of the City Engineer. Section 98. Obstruction of Street - Railway Traffic. It shall be unlawful for any person to place or cause to be placed on the tracks of the street railway company any Obstruction of any kind and it shall be unlawful for the driver of any vehicle to drive so as to interfexe or obstruct the passage of any street car. Section 99. Bells or Gongs on Street Cars. It shall be unlawful for the operator of any street car to approach any street intarsect ion without first sounding a warning with a gong or bell. Section 100, Street Cars art `�raffic Regulations. It shall be unlawful for the operator of any street oar to fail to comply *ith all traffic regulations herein made applicable to such cars, insofar as their being on rails will permit. Section 101. Railro%d Crossing. It shall be unly. dul for any Person to drive or ride any vehicle or animal across any railroad crossing over which passenger trains are operated on regular schedule in the city limits without first having come to a complete stop not less than fifteen feet nor more then fifty feet from said crossing, except where watchmen are maintained. This section shall also apply to operators of street cars. Section 102. Loading and Unloading Zones. Loading and unloading zones fifty f9et in length shall be marked by the Police Department near the middle of each blook in the Congested Die tr ict , on the north side of West Fourth Street from Main Street to tha alley to the west and on the north side of West Sixth Street beginning at the alley between Ruin and Louisiana Street and extending seventy -five feet eastward to%vard Uain Street. Tt shall be unlawful for any driver of any vehiole to park in these zones ox to stop except momentarily to discharge or pick up passengers. It shall be unlawful for drivers of trucks or delivsxy wagons to use these zones except where no alley exists. Section 103. Intercity Bus Companies Shall .3stabl ish Depots. Intercity bus companies shall establish depots, the lo.-ation of which shall be approved by the Council and shall load and unload their passengers on private property. Section 104. Routes of Intercity Busses. Intercity busses shall go from their depot to their destination on a route approved by the Council to the city limits. Section 105. Obstructing Watercourses. It shall be unlawful for any person to obstruct any drain culvert or watercourse, on the streets or alleys of this city by building or maintaining any bridge or other easement from the street or allay to private property unless same has been approved by the City Engineer. It shall be unlawful for any one to enter a motor driven vehicle not his own, attempt to start the motor or drive it without permission from the own .3r . Section 109. Automobile Keys. It shall be unlawful for any one to have in his possession any keV or keys for the purpose of starting any car not his own. Section 110. Backing Vehicles, It shall be unlawful for the driver of any vehicle to back it out of any alley, except blind allWa l or around arjr street oorner, Section 111. Penalties. Any person violating any of the sections of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in arr sum not less than two dollars and court costs nor more than five dollars and c our t oasts, unless specifically provided for further in this section. Any person vio- lating any of the following sections of thts ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined or punished as follows: Sections 4, 8, 219 279 329, 389 65, 66, 108, and 109, any sum not less than f the dollar s and court costs nor more than twenty -five dollars and court cost s. Sections 26, 28, 29, 30, and 339 any sum not less than twenty -five dollars and court costs nor more th n one hundred dollars and court costs. For violation of Sections 8, 26, 28, 291, 32, 33, 65, 79 and 83 by a chauffeur licensed by the City, the Municipal Judge may revoke said license in addition to fines assessed. Section 112. Repealing.
