3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE A QUITCLAIM DEED TO JENNIFER BALDWIN AND BENTLEY
5 STRACENER, JR.; AND FOR OTHER PURPOSES.

7 WHEREAS, on January 12, 2005, Jennifer Baldwin and Bentley Stracener, Jr. provided to the City a
8 warranty deed for right -of -way and a temporary construction easement along "M" Street in connection
9 with the widening of "M" Street, and
10 WHEREAS, a question has arisen as to whether the property to be conveyed was identified correctly,
11 and
12 WHEREAS, to eliminate any ambiguity and to fulfill the clear intent of the parties for the City to
13 acquire only new right -of -way and a temporary construction easement on the property owned by Baldwin
14 and Stracener, it is desirable for the City to provide a quitclaim deed to them for any property they may
15 have in error deeded to the City beyond the requested right -of -way.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved by the
19 City Attorney, a quitclaim deed and any other documents required to convey to Jennifer Baldwin and
20 Bentley Stracener, Jr. certain property described as follows:
21 Lot 22, Block 15, Riffel and Rhoten Forest Park Highlands Addition to the City of Little
22 Rock, Pulaski County, Arkansas, Reserving the South 5 feet for the City of Little Rock for
23 Right of Way Easement.

25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 resolution.
30 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
31 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
