HomeMy WebLinkAbout130071 RESOLUTION NO. 13,007 2 3 A RESOLUTION TO APPROVE THE RED FLAGS RULES PROCEDURE 4 GUIDELINE FOR THE CITY OF LITTLE ROCK, ARKANSAS, DESIGNED TO 5 DETECT THE WARNING SIGNS OR "RED FLAGS" OF IDENTITY THEFT IN 6 DAY -TO -DAY OPERATIONS, TAKE STEPS TO PREVENT THE CRIME AND 7 MITIGATE THE DAMAGE IT INFLICTS; AND FOR OTHER PURPOSES. 8 9 WHEREAS, The Red Flags Rule was promulgated in 2007 pursuant to Section 114 of the Fair and 10 Accurate Credit Reporting Act of 2003; and 11 WHEREAS, The Federal Trade Commission (FTC) requires every creditor to implement an Identity 12 Theft Prevention Program (ITPP); and 13 WHEREAS, The FTC has set forth the ITPP requirement in 16 C.F.R. Subsection 681.2; and; 14 WHEREAS, "Identity theft" means a fraud committed or attempted using the identifying 15 information of another person without authority; and 16 WHEREAS, The City of Little Rock, Arkansas, maintains "identifying information" for certain 17 customers or vendors such as the Name, Social Security number, date of birth, official state or 18 government issued driver's license or identification number, alien registration number, government 19 passport number, employer or taxpayer identification number; and 20 WHEREAS, The FTC Red Flags Rule requires the approval of an entity's first written Red Flags 21 Program by the Board of Directors; 22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK, ARKANSAS: 24 Section 1. The Board of Directors hereby approves the City of Little Rock, Arkansas, Red Flag 25 Rules Procedure Guideline. 26 Section 2. The Board of Directors hereby authorizes the City Manager to designate the Compliance 27 Officer with responsibility for the Red Flag Program. 28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 resolution. 33 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 34 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
