HomeMy WebLinkAbout129741 2 RESOLUTION NO. 12,974 3 A RESOLUTION TO SEEK ASSISTANCE FROM THE GOVERNOR OF 4 ARKANSAS, AND FROM OTHER ENTITIES, TO DEVELOP A POLICY s DIRECTIVE FOR THE DISPOSAL OF DRILL CUTTINGS THAT ORIGI- 6 NATE FROM DRILLING OPERATIONS THAT USE OIL BASED DRILL- 7 ING FLUIDS, AND OTHER METHODS OF EXTRACTING PETROLEUM, s TO ASSURE NOT ONLY THE SAFETY, BUT ALSO THE COMFORT AND 9 ENJOYMENT OF CITIZENS' PROPERTY; AND FOR OTHER PURPOSES. 10 11 WHEREAS, within the last 12 months the global petroleum market has seen the price for a 12 single barrel of oil skyrocket to the price of one hundred dollars ($100.00) a barrel of oil; and 13 WHEREAS, these kinds of prices make it economically feasible to discover and utilize 14 methods to extract oil products that have not traditionally been used such as the extraction of oil 15 from shale; and, 16 WHEREAS, the waste byproducts from these new technologies will have to be disposed of 17 in sanitary landfills designed to accept such waste at the price of the comfort and enjoyment of 18 private property because of the noxious odor of these products, and will also have other potential 19 damaging impacts upon the environment; and, 20 WHEREAS, the development of a temporary solution to address these problems in a particu- 21 lar locality may be acceptable for that locality, but a more permanent solution must be reached 22 for all citizens of the State of Arkansas; and, 23 WHEREAS, the Governor of the State of Arkansas is in a unique position to bring together 24 the legislative and executive branches of government, and accept citizen input on such issues; 25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 Section 1. The Board of Directors of the City of Little Rock, Arkansas, encourages Governor 28 Mike Beebe to create an executive entity to review in detail the kinds of processes that will be 29 used to extract petroleum based products within the State in order to address the oil needs of its 30 citizens, and to develop means to dispose of such waste byproducts without endangering the [PAGE 1 OF 21 Resolution to encourage Governor Beebe to create a body to address disposal of byproducts created by new technologies created to extract petroleum products 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 safety of the State's citizens, and without a negative impact upon the use and enjoyment of their private property. Section 2. The Board of Directors offers its assistance, and the assistance of any City em- ployees, in such effort, as the Governor may need. Section 3. Upon passage and execution of this Resolution, the City Clerk is directed imme- diately to transmit a copy of this Resolution to the Office of the Governor. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 5. Repealer. All laws and parts of laws inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
