HomeMy WebLinkAbout12932ORDINANCE NO. 12,932 AN ORDINANCE ESTABLISHING RIVERDALE LEVEE IMPROVEMENT DISTRICT NO, 134 OF LITTLE ROCK, ARKANSAS. WHEREAS, parties claiming to be the owners of a majority in assessed value of the real property located within the territory hereinafter described have filed a petition praying that an improve- ment district be established for the purposes hereinafter set out; a nd WHEREAS, after due notice as required by law, the City Board of Directors of Little Rock, Arkansas, has heard all parties desiring to be heard and has ascertained that said petition was signed by a majority in assessed value of the owners of real property within said territory; now, therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There is hereby established an improvement district embracing the following property in the City of Little Rock, Arkansas, to -wit: r A tract of land situated in part of Sections 28, 29, 32 and 33 Township 2 North, Range 12 West, Pulaski County, Arkansas and being more particularly described as follows: Starting at the Southeast corner of the NW4, SW4, Section 33, Township 2 North, Range 12 West; thence N 10 35' E, 464.0 feet to the Point of Beginning; thence N 880 43' W, 687.21 feet to a point on the East Right -of -Way line of the Chicago, Rock Island and Pacific Railroad; thence N 510 41' W along said East Right -of -Way line 1,237.63 feet; thence continue along said East Right -of -Way line on a curve to the right having a chord bearing of N 330 25' 50" W, 865.96 feet; thence continue along said East Right -of -Way line N 150 10' 40" W, 3,976.88 feet to its intersection with the East Right -of -Way line of Rebsamen Park Road; thence run along the East Right -of -Way line of Rebsamen Park Road N 110 48' E, 139.03 feet; thence continue along said East Right -of -Way line N 50 04' E, 113.20 feet to its intersection with the center line of Jordan Bayou; thence run along the center line of Jordan Bayou having the follow- ing bearings and distances: S 490 06' E, 56.30 feet; N 530 53' E, 61.00 feet; N 490 59' E, 125.10 feet; N 450 51' E, 117.4 feet; N 440 33' E, 168.80 feet; N 750 57' E, 67.70 feet; N 600 23' E, 235.10 feet; N 580 07' E, 127.00 feet; N 450 54' E, 109.70 feet; N 860 50' E, 104.40 feet; N 830 03' E, 157.20 feet to the ordinary high water line on the West Bank of the Arkansas River; thence along the ordinary high water 'Line on the West Bank of the Arkansas River having the following chord bearings and distances: S 400 13' 20" E, 166.87 feet; S 240 26' 40" E, 276.02 feet; S 240 02' 40" E, 526.84 feet; S 460 12' 20" E, 162.97 feet; S 180 37' 40" E, 565.66 feet; S 270 00' 20" E, 672.37 feet; S 1.70 57' 20" E, 696.50 feet; S 270 25' 40" E, 713.30 feet; S 230 15' 20" E, 292.35 feet; S 220 15' 20" E, 396.92 feet; S 240 22' E, 665.15 feet; S 250 56' 40" E, 346.96 feet; S 250 33' 40" E, 247.13 feet; S 140 18' E, 122.76 feet;S600 21' E, 121.17 feet; S 350 32' 40" E, 119.41 feet; S 280 09' 20" E, 326.97 feet; S 370 26' 20" W, 22.88 feet to the South property line of Riverdale Country Club; thence N 880 51' 40" W, 329.25 feet; thence S 10 14' 40" W, 426.27 feet; thence N 880 37' 40" W, 357.15 feet to the Point of Beginning and con- taining 254.62 acres, more or less; less and except that part previously dedicated for overpass Right -of -Way. for the purpose of constructing, relocating, improving, maintaining, and keeping in repair a system of levees, banks, ponds, pumps, and drainage in order to protect the above described territory from flood- ing and overflow; and for the purpose of acquiring by gift, purchase, or the exercise of its right of eminent domain by condemnation the necessary lands for rights -of -way and easements to accomplish the im- provements as herein described; all in such manner and with such ma- aerials as the commissioners to be elected for said improvement dis- trict shall deem to be for the best interest of said district, and that the cost thereof be assessed and charged upon the real property above described. SECTION 2. The life of the district shall be pro- longed and continued, after the completion of the original improvement contemplated, for the purpose of maintaining, making improvements thereto, and keeping such improvements in a good state of repair, at any and all times and in such manner as the Commissioners to be elected for the district shall in their sole judgment deem to be for the best interests of the district at an estimated cost of $20,000.00 annually, and that the cost of such maintenance, improvement or repairs, together with interests and costs of borrowed money, be assessed and charged upon the real property hereinabove described, now or at such later times as may be deemed necessary by the Commissioners of the strict. SECTION 3. Said District shall be known as "Riverdale Levee Improvement District No. 134 of Little Rock, Arkansas," and R. D. Rawn, Thomas E. Downie, and R. A. Lile are hereby named Commissioners, who shall compose the Board of Improvement for said District. SECTION 4. This ordinance shall take effect and be in force from and after its passage.
