HomeMy WebLinkAbout12794.,01111111111 /ll". 1 2 3 2008083037 Received: 12/12/2008 1:08:06 PM Recorded: 12/12/2008 01:27:30 PM Filed & Recorded in Official Records of PAT O- BRIEN, PULASKI COUNTY CIRCUIT /COUNTY CLERK RESOLUTION NO. 12,794 Fees $25.00 N TO AUTHORIZE THE CITY MANAGER, MAYOR AND CITY CLERK 4 TO EXECUTE ANY DOCUMENTS NECESSARY AND TAKE OTHER ACTIONS 5 NEEDED TO ACCEPT THE DONATION OF A 3,075 SQUARE FOOT LOT LOCATED 6 AT THE NORTHEAST CORNER OF APPIANWAY AND WEST 10TH STREETS; AND 7 AN ADJACENT 2,000 SQUARE FOOT INTERIOR LOT FACING APPIANWAY 8 STREET; AND FOR OTHER PURPOSES. 9 10 WHEREAS, THE TRIANGLE GROUP, LLC desires to donate to the City two lots that it owns directly 11 south of Fletcher Park, and 12 WHEREAS, this property is essential to the City's plan to expand Fletcher Park and will help the 13 Park System achieve the Master Parks Plan of linking neighborhoods and having parkland available to all 14 sections of the City to create a "City in a Park," and 15 WHEREAS, this property is currently zoned "PR" Park and Recreation District, and the City's Future 16 Land Use Plan designates this area as "Park /Open Space ", and 17 WHEREAS, the City researched the property sought to be donated and conducted a Phase I Envi- 18 ronmental Site Assessment through ATOKA, Inc., which stated that the site visit of the property re- 19 vealed no environmentally recognized conditions and no potential environmental concerns that would 20 warrant additional evaluation or action, and 21 WHEREAS, the Board of Directors has determined that the acquisition of the subject property 22 would be beneficial to the interests and welfare of the citizens of the City, and 23 WHEREAS, the Little Rock Board of Directors deems it appropriate to accept the donation of two 24 lots from THE TRIANGLE GROUP, LLC for park purposes of expanding Fletcher Park. NOW, THEREFORE, 25 BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 26 Section 1. The Board of Directors hereby authorizes the City Manager, Mayor and City Clerk to 27 execute any documents necessary for the City to accept the donation of two parcels by THE TRIANGLE 28 GROUP, LLC totaling 5,075 square feet, more or less, directly south of Fletcher Park at the corner of 29 10th and Appianway Streets that is more particularly described in Attachment A to this resolution. The 30 City agrees to pay the cost of the environmental assessment, the title search and closing costs, up to a 31 maximum of $4,000 for all of such costs taken together as a whole. 32 Section 2. Upon obtaining ownership of the donated parcel, the City agrees to maintain the parcel 33 consistent with the level it maintains its neighborhood parks, such that the use and appearance of the 34 property shall be enhanced for the entire public. 35 Section 3. Funds for the environmental assessment, title search and closing costs, in an amount 36 not to exceed $4,000.00, are available through Bond Account Number 316 - 459- BOOPC83. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such decta- ration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsi tency.
