HomeMy WebLinkAbout126691 RESOLUTION NO. 12,669 2 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT 4 WITH CLEVELAND BAILEY AS PART OF THE MID -CITY TARGETED 5 NEIGHBORHOOD ENHANCEMENT PLAN FOR REHABILITATION OF A SINGLE - 6 FAMILY RESIDENCE AT 2222 SOUTH OAK STREET IN THE APPROVED MID -CITY 7 TNEP AREA. 8 9 WHEREAS, the City has been granted authority to contract with owners of property to agree to 10 live in residential dwellings in targeted neighborhoods for a period of five (5) years, and to use the 11 consideration for such agreements to construct or rehabilitate residential structures in an effort to 12 recapture or rehabilitate neighborhoods that have become urban blight, or that could become an area 13 of blight if such actions are not taken, and 14 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. SS 14 -169- 15 1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the Act "), the City 16 Board of Directors has completed the process and determined that this area in the City qualifies as a 17 targeted neighborhood as defined by the Act, and 18 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted Little 19 Rock, Ark., Resolution No. 12,301 (June 20, 2006), and designated this portion of the City as the Mid - 20 City Targeted Neighborhood Enhancement Plan area (hereinafter referred to as the "Mid -City TNEP "), 21 and 22 WHEREAS, the Owner, Cleveland Bailey, has submitted an appropriate application to contract 23 with the City to rehabilitate an owner - occupied residential structure within the boundaries of the Mid - 24 City TNEP in the amount of Thirteen Thousand, Nine Hundred Eighty -two Dollars ($13,982.00), and 25 WHEREAS, the City desires to contract with the Owners pursuant to the Mid -City TNEP 26 program, and the Owner desires to assure the residency requirements of the TNEP program are met so 27 this neighborhood can be recaptured and a meaningful residential area can be developed, 28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 29 ROCK ARKANSAS: 30 Section 1. The City Manager is authorized to execute a contract with Cleveland Bailey for the 31 rehabilitation of the residence at 2222 South Oak Street in the approved Mid -City TNEP. 32 Section 2. This action authorizes a $13,982.00 contract between the City of Little Rock and 33 Cleveland Bailey to support construction activities at 2222 South Oak Street in the Mid -City TNEP area. 34 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 35 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such 36 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
