3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 EXCECUTE A LEASE PURCHASE AGREEMENT WITH THE TRUST
5 FOR PUBLIC LAND FOR A FORMER SECTION OF THE UNION
6 PACIFIC RAILROAD LINE FOR THE SUM OF $820,286.84; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, a system of trails for the recreation and enjoyment of the public is an
10 important part of the City's Master Parks Plan (July 17, 2001) and the City's Master Bike
11 Plan, and
12 WHEREAS, on November 4, 2003, the voters of the City overwhelmingly
13 supported the issue of trail acquisition and development in a bond election, and
14 WHEREAS, the Board authorized the issuance of $70,635,000 in Limited
15 Obligation Capital Improvement Bonds (Series 2004), of which $13,800,000 was to be
16 used for parks and recreation capital improvements, some of which have been used to
17 purchase certain property, formerly sections of the Union Pacific railroad line, from The
18 Trust for Public Land for a walking and bike trail, and
19 WHEREAS, the City would like to acquire from The 'T'rust for Public Land
20 another section of former Union Pacific railroad line contiguous to the already acquired
21 sections for an additional cost of $820,286.84, to be paid from State of Arkansas
22 appropriations for the Arkansas River Trail, federal funds acquired for the purpose, and
23 other Parks and Recreation monies and other public and private funds, and
24 WHEREAS, the Little Rock Board of Directors deems it appropriate and in the
25 best interest of the public health, safety and welfare to enter into a lease purchase
26 agreement for a period of one year, with the possibility of an extension of an additional

I year if needed, for the acquisition of the identified property for the stated amount from
2 the Trust.
3 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
4 THE CITY OF LITTLE ROCK, ARKANSAS:
5 Section 1. The Board of Directors hereby authorizes the City Manager to enter
6 into a one -year lease purchase agreement with The Trust for Public Land, in a form
7 acceptable to the City Attorney, for the acquisition by the City of certain property,
8 formerly Union Pacific railroad line, from the Trust for Public Land for the total cost of
9 $820,286.84. The property is more particularly described in Exhibit A to this resolution.
10 Section 2. Sources of monies. The monies to purchase the property derive from
11 the following sources: (1) $200,000 in State of Arkansas appropriations for the Arkansas
12 River Trail; (2) approximately $170,000 in federal funds; and (3) the remainder to come
13 from Little Rock Parks & Recreation monies and other public and private funds.
14 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
15 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
16 unconstitutional, such declaration or adjudication shall not affect the remaining
17 portions of the resolution which shall remain in full force and effect as if the portion so
18 declared or adjudged invalid or unconstitutional were not originally a part of the
19 resolution.
20 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
21 are inconsistent with the provisions of this resolution, are hereby repealed to the extent
22 of such inconsistency.
