AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED AKEL SHORT -FORM PCD
(Z- 8236), LOCATED ON THE NORTHEAST CORNER OF
COLONEL GLENN AND JOHN BARROW ROADS, LITTLE
ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP
OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from C -3 and R -4 to PCD:
Tract 1 - Part of the NE '/4 of the NW '/4 Section 23, T -1 -N, R -13 -W,
Pulaski County, Arkansas described as: commencing at the intersection of
the centerline of Barrow Road and the centerline of Arkansas State
Highway 5; thence Northerly along the centerline of Barrow Road 30 feet,
more or less, to a point in the north right of way line of Highway 5,;
thence in an easterly direction along the north right of way line 30 feet to
the point of beginning, from the point of beginning run easterly along the
north right of way line of Highway 5, 125.0 feet; thence northerly parallel
to Barrow 125.0 feet; thence westerly perpendicular to Barrow Road,
125.0 feet more or less, to the east right of way to the point of beginning
containing 0.36 acres, more or less.
Tract 2 — Part of the NE '/4 of the NW ' /4, Section 23, T -1 -N, R -13 -W,
Pulaski County, Arkansas, described as follows; A strip of land 50 -feet
wide by 178 feet more or less deep fronting on Barrow Road and lying
immediately north of the tract conveyed by Fred J. Nowlin et al to Lion
Oil Company as shown by Deed Record Book 543 page 429, more
particularly as part of the NE'/4N W '/4 Section 23, T -1 -N, R -13 -W, Begin
at a point on the East right of way line of Barrow Road which is 131.03
feet measured along the east right of way line of Barrow Road of the north
right of way line of US Hwy 67 -70 commonly called 19th Street Pike, said
point beginning being the northwest corner of the Tract conveyed to Lion
Oil Company by Deed Record Book 543 Page 429 mentioned above,
thence N89 °E perpendicular to Barrow Road a distance of 178 feet more
or less to the east line of the tract conveyed to Northwest Land Company,
Inc. as shown by Deed Record Book 543 Page 431, thence North 50 feet;
thence S89 °W 178 feet; more or less to the East line of Barrow Road,
thence south along the east line of Barrow Road a distance of 50 -feet to
the point of beginning, containing 0.2 acres, more or less.
Less and Except that part of Tract 1 and 2 conveyed to the City of Little
Rock for right of way — A tract of land situated East of John Barrow Road
and North of Asher Avenue, said tract being part of the NE 1/4 NW 1/4
Section 23, T -1 -N, R-13-W, Pulaski County, Arkansas, being more
particularly described as follows: Beginning at the intersection of the
existing east right of way line of John Barrow Road with the existing north
right of way line of Asher Avenue; thence N00 °49'45 "E along said
existing east right of way line 181.21 feet; thence S89 °12'27 "E, 1.0 feet;
thence along the proposed right of way line of John Barrow Road the
following courses and distances; S00 °49'45 "W 50 feet; thence
S89 °12'27 "E, 3.5 feet; thence S00 °49'45 "E 86.53 feet; thence
S48 004'05 "E 52.46 feet; thence N87 °59'38 "E along the proposed north
right of way line of Asher Avenue, 80.29 feet; thence S00 °53'56 "W 8.04
feet; thence S87 °59'39 "W along the existing north right of way line of
Asher Avenue, said line lying 30 feet more or less north of the center line
of Asher Avenue, 125.0 feet to the point of beginning containing 0.0479
acres more or less.
Tract 3 — Part of the NE 1/4 of the NW 1/4, Section 23, T -1 -N, R -13 -W,
Pulaski County, Arkansas, more particularly described as follows:
Beginning at a point 927.7 feet south and 155 -feet east of the northwest
corner of the NE 1/4 NW 1/4 of said Section 23; run thence East 53 feet;
thence run south 122.7 feet to a point on the northerly right of way line of
Old US Highway No. 70; thence Southwesterly along said north right of
way line of Old US Highway 70 a distance of 53 feet; thence North 125.2
feet to the point of beginning containing 0.15 acre more or less.
Less and Except A tract of land situated in the NE 1/4 of the NW 1/4,
Section 23, T -1 -N, R -13 -W Pulaski County, Arkansas, being more
particularly described as follows: Beginning at a point on the existing
north right of way line of Asher Avenue, said point being N87 °59'39 "E
125.0 feet along said right of way line from its intersection with the
existing east right of way of John Barrow Road; thence N00 °53' 56 "E
10.04 feet; thence N87 °59'39 "E along the proposed north right of way line
of Asher Avenue 51.89; thence S00 °47'33 "W, 10.05 feet; thence
S87 °59'39 "W along said existing north right of way line 51.91 feet to the
point of beginning.
SECTION 2. That the approval of Akel Short-form PCD (Z- 8236), located on the
Northeast corner of Colonel Glenn and John Barrow Roads is subject to compliance with
the following additional conditions:
• That the preliminary site development plan/plat be approved as
submitted, including all staff comments and conditions as outlined in
the Planning Commission Agenda Staff Report in paragraphs D, E, F
and including any conditions indicated in the staff analysis in

paragraph H and subject to additional conditions imposed at the
Planning Commission Public Hearing as amended by the applicant.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for Ake]
Short-form PCD (Z- 8236), located on the Northeast corner of Colonel Glenn and John
Barrow Roads is conditioned upon obtaining a final plan approval within the time
specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severrability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
