3 AN ORDINANCE TO ABANDON THE ABANDONMENT OF UTILITY EASEMENTS
4 LOCATED WITHIN LOTS 22 AND 23, SPRING VALLEY MANOR SUBDIVISION,
5 LOCATED AT #1 VISTA DRIVE, IN THE CITY OF LITTLE ROCK, ARKANSAS,
6 AS PUBLIC RIGHT -OF -WAY; AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to vacate and abandon two utility easements located within Lots 22
9 and 23, Spring Valley Manor Subdivision at #1 Vista Drive, as public right -of -way, pursuant to the City's
10 general police power authority under Ark. Code Ann. S 14 -54 -104; and
11 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
12 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right -of-
13 way abandoned by this ordinance is no longer needed for corporate purposes;
14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
15 ROCK, ARKANSAS:
16 Section 1. The Board of Directors hereby releases, vacates, and abandons two utility easements
17 located within Lots 22 and 23, Spring Valley Manor Subdivision at #1 Vista Drive, in the City of Little
18 Rock, Arkansas, more specifically described in Exhibit "A ", attached hereto.
19 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real
20 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
21 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
22 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
23 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
24 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was
25 not originally a part of the ordinance.
26 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
27 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
28 inconsistency.

Subdivision, less and except the north 20' of the south 30' thereof; and a strip of land
10' in width lying adjacent and parallel to the south line of Lot 23, Spring Valley Manor
Subdivision.
