HomeMy WebLinkAbout19823ORDINANCE NO. 19,823 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED OFFICE DISTRICT TITLED DAV SHORT -FORM POD (Z- 5535 -C), LOCATED AT 12415 CANTRELL ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 to POD: Part of the SE 1/4 NE '/4 of Section 20, T -2 -N, R -13 -W, Little Rock, Pulaski County, Arkansas more particularly described as follows: Beginning at a point on the south right of way line of Arkansas State Highway 10, being N01 '58'28"E, 1106.07 feet from the Southeast corner of the NE 1/4, said Section 20: thence S01 °58'28 "W along the east line of said NE 1/4, 279.42 feet; thence N63 °20'01 "W, 198.50 feet; thence S24 °35'17 "W, 16.96 feet; thence northwesterly along the arc of a 170.74 foot radius curve to the right, a chord bearing and distance of N58 °48'39 "W, 44.06 feet; thence S51 °58'28 "W, 21.62 feet; thence northwesterly along the arc of a 132.40 foot radius curve to the right a chord bearing and distance of N33 °44'28 "W, 90.95 feet; thence N13 027'48 "E along the center of an existing driveway, 175.44 feet to a point on the said south right of way line of Arkansas State Highway 10; thence N89 °48'41 "E along said right of way line, 56.19 feet; thence S76 °01'25 "E continuing along said south right of way line, 208.44 feet to the point of beginning, containing 1.6053 acres more or less. SECTION 2. That the approval of DAV Short-form POD (Z- 5535 -C), located at 12415 Cantrell Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for DAV Short- form POD (Z- 5535 -C), located at 12415 Cantrell Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
