BOARD OF DIRECTORS MEETING
City Hall — 500 W. Markham
April 3, 2007 - 6:00 PM
The Board of Directors of the City of Little Rock, Arkansas met in regular session with Mayor
Stodola presiding. City Clerk, Nancy Wood, called the roll with the following Directors present:
Hendrix, Cazort, Keck, Wright, Wyrick, Kumpuris, Fortson, Adcock, Vice Mayor Hurst, and
Mayor Stodola. Director Cazort gave the invocation, which was followed by the Pledge of
Allegiance.
PRESENTATIONS:
Fair Housing Month Proclamation (April 3, 2007)
Mayor Stodola read the proclamation and presented it to Mayo Johnson (Chair) and Don Darnell
from the Racial and Cultural Diversity Commission.
Mayor Stodola mentioned that he was interested in having the Racial and Cultural Diversity
Commission present to the Board of Directors some information regarding the inclusion of
diversity in the invocation at Board meetings. He then went on to ask the Board to consider the
modifications.
Director Hurst, seconded by Director Adcock, made a motion to make the modifications to the
agenda. By unanimous voice vote of the Board Members present, the motion carried.
M -1. PRESENTATION
Mayor's Advertising and Promotions Review Committee Update (April 3, 2007)
The Mayor introduced the members of the independent review committee — Judge John Pleggee,
Jack Murphy, Dr. Marion Lacey, Paula Casey, and Orville Abrams. Two (2) members not
present were Mike Shifley and John Sturey. He indicated that the 30 page report, listing the
recommendations (about 78), would be available on the City's webpage.
The Consent Agenda consisting of Items 1- 7 was read.
Consent Agenda: Items 1 -7
1. MOTION - Little Rock Board of Directors Meetings: March 6, 2007; March 20, 2007; and
Reconvened Meeting: February 27, 2007.
2. RESOLUTION 12,477 - G -23 -379 - To set the date of public hearing for April 17, 2007, on
a request to abandon a public right -of -way located in Block 12 of the Centennial Addition and
easements within the alley of the right -of -way. Planning Commission: 9 ayes, 2 absent. Staff
recommends approval. Synopsis: The applicant is requesting the alley located in Block 12
of the Centennial Addition be abandoned as public right -of -way; including any easements
within the area of the alley.

3. RESOLUTION 12,478 - Authorizing the City Manager to enter into a contract with
Commercial Air, Inc. to supply HVAC control repairs on an as needed basis. This contract will
be for one (1) year with an option to extend for an additional four (4) years. Staff recommends
approval. Synopsis: Authorizing the City Manager to enter into a contract with
Commercial Air, Inc. to supply HVAC control repairs on an as needed basis.
4. RESOLUTION 12,479 - To approve uses of HOME Investment Partnership Program
balance of funds. Staff recommends approval. Synopsis: The City receives HOME Investment
Partnership Program funds from the Department of Housing and Urban Development.
5. RESOLUTION 12,480 - Authorizing the City Manager to approve contracts and agreements
for the construction of new sidewalks in the Forest Park Elementary School neighborhood
under the Arkansas Safe Routes to School grant program. Staff recommends approval.
Synopsis: The project is contingent on grant award.
6. RESOLUTION 12,481 - To authorize the Mayor to dedicate a strip of City -owned land at
the Terry Public Library as right -of -way for the Napa Valley Drive (Hinson Road to St.
Charles Boulevard) Improvement Project; and for other purposes. Synopsis: Authorizes the
Mayor to dedicate City -owned land as public right -of -way for the Napa Valley Drive
(Hinson Road to St. Charles Boulevard) construction project.
7. RESOLUTION 12,482 - To approve the settlement agreement with Arkansas Riverview
Development, LLC, and other parties to federal litigation as to City air rights over Garland
Street, the City's relationship with Capitol City Hotel Limited Partnership (the Doubletree
Hotel); and for other purposes.
A motion was made by Director Adcock, seconded by Director Hurst, to approve the Consent
Agenda. By unanimous voice vote of the Board Members present, the Consent Agenda was
adopted.
CITIZENS COMMUNICATIONS
Speaker: Marc and Krystal Singleton, Wakefield Addition Homeowners
Topic: They spoke of code enforcement issues in the southwest Little Rock area and
added that the Code Officers were not sensitive to needs of some of the citizens.

Topic: Code Enforcement Complaints — He read his notice of complaint
To: Little Rock Mayor Mark Stodola and the Board of Directors
We, the undersigned residents of the City of Little Rock, hereby request that you do all that is in your
power to cause the Code Enforcement Section of the Neighborhood Programs Division to cease and desist
from unreasonable harassment of ourselves and our neighbors.
Code Enforcement personnel have a history of lying to us by telling us that items or conditions were a
violation when in fact they were not prohibited.

They have tried to intimidate us by threatening us with hundreds of dollars in fines if we do not get our
properties "looking right ". We believe "looking right" to be a matter of "esthetics ", not "law ".
They have practiced "selective enforcement" by reporting alleged violations at some properties while
not reporting the same or very similar conditions at the other properties. They also perform regular and /or
frequent "sweeps" of some neighborhoods while mostly or completely failing to do so in other areas of
town.
We ask that the above practices stop immediately.
Speaker: Luke Skrable
Topic: Concerns about form of City Government. He stated that the City needs one
leader who can be held accountable when citizens do not receive services.
Speaker: George Irvin
Topic: Asked the Board to save War Memorial Golf Course.
Speaker: Wilma Smith
Topic: Problems with CDBG & Housing Programs, and Duncan Home Improvement out
of Pine Bluff. She claims that the work was not done properly or not at all.
Director Adcock, seconded by Director Hurst, asked that Item 13 be removed from the Grouped
Items and handled separately. By unanimous voice vote of the Board Members present, Item 13
was held separately.
The grouped items were read the first time.
GROUPED ITEMS: 8 - 21
8. ORDINANCE 19,720 - LU07- 29 -01- To amend the Land Use Plan (16,222) in the Barrett
Planning District from Single - Family and Suburban Office to Commercial (with PZD required),
and Suburban Office; and for other purposes. Planning Commission: 9 ayes, 2 absent. Staff
recommends approval. Synopsis: Land Use Plan Amendments in the Barrett Planning
District from Single - Family and Suburban Office for future development.
9. ORDINANCE 19,726 - Z -8170 - Establishing a Planned Zoning District titled Pinnacle at
Maumelle Long -Form Conceptual PCD, located north of Highway 10 and north and west of
Pleasant Grove, Pulaski County, Arkansas; amending the Official Zoning Map of the City of
Little Rock, Arkansas; and for other purposes. Planning Commission: 9 ayes, 2 absent. Staff
recommends approval. Synopsis: The applicant is proposing a rezoning of the site from R -2
to PCD to allow a conceptual plan to be created and the uses established for future
development.

10. ORDINANCE 19,727 - Z -6062 — Repealing Ordinance Number 17,094 and revoking a
planned Zoning District titled McAlmont POD, located at 1814 -1824 McAlmont Street in the
City of Little Rock, Arkansas; and for other purposes. Planning Commission: 9 ayes, 2 absent.
Staff recommends approval. Synopsis: The applicant requests that the existing POD zoning
be revoked and the property revert to the originally zoned R -4, two (2) Family Zoning
District
11. ORDINANCE 19,728 - Z -3491 — Repealing Ordinance Number 13,842 and revoking a
Planned Zoning District titled Albert Pike Phase II PD, located at 221 East 7th Street in the
City of Little Rock, Arkansas, rezoning the property to UU, Urban Use District; amending the
Official Zoning Map of the City of Little Rock, Arkansas; and for other purposes. Planning
Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis: The applicant requests
that the existing PD zoning be revoked and the property rezoned to UU, Urban Use
District.
12. ORDINANCE 19,729 - Z- 5742 -A - Establishing a Planned Zoning District titled C & G
Asset Management Short -Form PCD, located at 1001 Wright Avenue, Little Rock, Arkansas;
amending the Official Zoning Map of the City of Little Rock, Arkansas; and for other purposes.
Planning Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis: The request
includes the rezoning of this site from 0-1 to PCD to allow the construction of a single
building with a total of 6,336 sq ft of office and retail space and twenty -three (23) on -site
parking spaces.
13. ORDINANCE 19,730 - Z- 4411 -G - Establishing a Planned Zoning District titled Pleasant
Ridge Towne Center Revised Long -Form PCD, located on the southeast corner of Cantrell
and Pleasant Ridge Roads; amending the Official Zoning Map of the City of Little Rock,
Arkansas; and for other purposes. Planning Commission: 9 ayes, 2 absent. Staff recommends
approval. Synopsis: The applicant proposes an amendment to the previously approved
PCD to allow additional building signage on the center building of the shopping center.
14. ORDINANCE 19,731 - Z- 7421 -B - Establishing a Planned Zoning District titled Mid -
Town Shopping Center Revised Long -Form PCD, located on the northeast corner of West
Markham Street and University Avenue, Little Rock, Arkansas; amending the Official Zoning
Map of the City of Little Rock, Arkansas; and for other purposes. Planning Commission: 9
ayes, 2 absent. Staff recommends approval. Synopsis: The applicant proposes a revision to
the existing PCD to allow a modification to the approved signage plan.
15. ORDINANCE 19,732 - Z- 7695 -A - Establishing a Planned Zoning District titled Smith
Revised Short -Form PD -R, located in the 1600 Block of South Battery Street; amending the
Official Zoning Map of the City of Little Rock, Arkansas; and for other purposes. Planning
Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis: The applicant is
requesting the rezoning of the property from R -3 to PD -R to bringing it into compliance
with the City Ordinance regarding the use of the property and to add a fifth unit to the
existing building.

16. ORDINANCE 19,733 - Z- 6554 -E = Repealing Ordinance Number 19,479 and revoking a
Planned Zoning District titled Bowman Kanis Retail Center Long -Form PCD, located on the
northwest corner of Kanis and Bowman Roads in the City of Little Rock, Arkansas; and for
other purposes. Planning Commission: 9 ayes, 2 absent. Staff recommends approval.
Synopsis: The applicant requests that the existing PCD zoning be revoked and the
property revert to its original R -2, 0-3, and C -3 zoning classifications.
17. ORDINANCE 19,734 - Z- 6554 -F — Reclassifying property located on the northwest corner
of Kanis and Bowman Roads, Little Rock, Arkansas, from R -2, 0-3, and C -3, to 0-3 and C -3;
amending the Official Zoning Map of the City of Little Rock, Arkansas, and for other purposes.
Planning Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis: USA Drug
owns this 13.9 acre site located on the northwest corner of Kanis and Bowman Roads and is
requesting the reclassification from R -2, 0-3 and C -3, to 0-3 and C -3.
18. ORDINANCE 19,735 - S- 1415 -C — Granting a variance from Various Lot Development
Standards of Chapter 31 of the Code of Ordinances of the City of Little Rock, Arkansas;
providing for a variance to allow the development of a lot without public street frontage for the
Kanis Bowman Preliminary Plat, located on the northeast corner of Kanis and Bowman Roads.
Planning Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis: The request
includes a variance from the Subdivision Ordinance to allow the development of a lot
without public street frontage.
19. ORDINANCE 19,736 - Z- 7699 -B - Establishing a Planned Zoning District titled Highway
10 Development Short -Form POD, located at 16603 and 16623 Cantrell Road, Little Rock,
Arkansas; amending the Official Zoning Map of the City of Little Rock, Arkansas; and for other
purposes. Planning Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis:
The applicant is requesting a rezoning of the site from POD and R -2 to POD to allow the
construction of three (3) additional buildings similar to the one already built adjacent to
the east, and a single -story building adjacent to Cantrell Road. 0-2 uses will be utilized as
allowable uses for the site.
20. ORDINANCE 19,737 - Z- 7786 -A - Establishing a Planned Zoning District titled Dennis
Properties Revised Long -Form PCD, located at 11421 Stagecoach Road, Little Rock,
Arkansas; amending the Official Zoning Map of the City of Little Rock, Arkansas; and for other
purposes. Planning Commission: 9 ayes, 2 absent. Staff recommends approval. Synopsis:
The applicant is proposing an amendment to the previously approved PCD to expand the
allowable uses for the site.
21. ORDINANCE 19,738 - Z -8168 - Establishing a Planned Zoning District titled Waters
Edge Tract B Long -Form PD -R, located north of David O. Dodd Road, East of Interstate
430, Little Rock, Arkansas; amending the Official Zoning Map of the City of Little Rock,
Arkansas; and for other purposes. Planning Commission: 9 ayes, 2 absent. Staff recommends
approval. Synopsis: The request is to rezone 6.05 acres located at the northeast corner of
Interstate 430 and David O. Dodd Road from R -2 to PD -R to allow the development of a
thirty -six (36) unit condominium project.

The grouped items consisted of Items 8 -12, 14 -21. Item 13 was held separate. A motion was
made by Director Adcock, seconded by Director Cazort, to suspend the rules and place the
ordinances on second reading. By unanimous voice vote of the Board Members present being
two - thirds in number, the rules were suspended and the ordinances were read the second time.
Director Adcock made the motion, seconded by Director Keck, to suspend the rules and place
the ordinances on third and final reading. By unanimous voice vote of the Board Members
present, the rules were suspended and the ordinances were read the third and final time.
A roll call vote was taken and recorded as follows: Directors Cazort, Keck, Wright, Wyrick,
Kumpuris, Fortson, Adcock, Hendrix, Vice Mayor Hurst, and Mayor Stodola voted yes. The
ordinances (Items 8 —12, and Items 13 - 21) were passed.
13. ORDINANCE 19,730 - Z- 4411 -G - Establishing a Planned Zoning District titled Pleasant

Item 13 was read by the City Clerk. A motion was made by Director Cazort, seconded by Vice
Mayor Hurst, to suspend the rules and place the ordinance on second reading. By unanimous
voice vote of the Board Members present being two - thirds in number, the rules were suspended
and the ordinance was read the second time. Director Adcock made the motion, seconded by
Director Keck, to suspend the rules and place the ordinance on third and final reading. By
unanimous voice vote of the Board Members present, the rules were suspended and the
ordinance was read the third and final time.
Ruth Bell, League of women voters, spoke in opposition of this item, arguing that this
application does not meet the sign requirements. Tony Bozynski, Planning Director gave an
overview of the application; stating that the building has a unique orientation to Cantrell Road
and the signage is appropriate for the building.
A roll call vote was taken and recorded as follows: Directors Cazort, Keck, Wright, Wyrick,
Kumpuris, Fortson, Adcock, Hendrix, Vice Mayor Hurst, and Mayor Stodola voted yes. The
ordinance (Item 13) was passed.
Board of Directors Updates and Requests:
Director Adcock gave an update on bills that the City had before the state legislative body.
The Mayor reported that the Board would have a discussion on the governance issues in the
future after all the information gathered at the public meetings was compiled and reviewed.
Bruce Moore, City Manager, introduced the "Who Do You Call" informational document.
Director Keck, seconded by Director Cazort, made a motion to adjourn the meeting. By
unanimous voice vote of the Board members present the meeting was adjourned at 7:16 PM.
