CODE CHAPTER 4 17, ARTICLE I, SEC. 17 -5 TO ALLOW ICE CREAM MOBILE UNITS TO PARK 5 WITHIN THE RIGHT -OF -WAY OF PUBLIC STREETS THAT ARE 6 PRIMARILY RESIDENTIAL STREETS IN THE CITY, AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, "mobile canteen unit' means a vehicle offering for sale to 10 consumers food products or beverages. 11 WHEREAS, the City of Little Rock, Arkansas (the "City") has not allowed mobile 12 canteen units to dispense any food or drink within the right -of -way of any public street 13 in the city. 14 WHEREAS, it has been determined to adequately service its customers, that ice 15 cream mobile units should have access to the right -of -way of the public streets. 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 17 OF THE CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. Little Rock, Ark., Rev. Code §17 -5(b) is hereby amended to read as 19 follows: 20 (b) No mobile canteen unit shall under any circumstances dispense any 21 food or drink when legally parked within the right -of -way of any public street in 22 the city, except ice cream mobile units, which shall be restricted to the licensing 23 and operating rules set forth by the Finance Department of the City of Little 24 Rock. 25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, 26 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or [PAGE 1 OF 51 I unconstitutional, such declaration or adjudication shall not affect the remaining 2 portions of the ordinance which shall remain in full force and effect as if the portion so 3 declared or adjudged invalid or unconstitutional was not originally a part of the 4 ordinance. 5 Section 3. Repealer. All ordinances and resolutions, and parts thereof, which are 6 in conflict with any provision of this ordinance are hereby repealed to the extent of such 7 conflict. 8 Section 4. Effective Date. Carpenter 22 H 23 H 24 H 25 H 26 H 27 H [PAGE 2 OF 5] Attachment PRE - LICENSING REGULATIONS ICE CREAM MOBILE UNITS These licensing regulations apply to ice cream mobile units, which are motorized, and who only sell pre - packaged, over - wrapped ice cream novelties, frozen confections and bottled soda pop. Pushcarts are excluded along with other vehicles that prepare or dip ice cream, sno -cones or frozen confections in the vehicle. BEFORE LICENSING YOU MUST COMPLY WITH THE FOLLOWING 1. You must have a fixed business location on zoned property where the ice cream mobile units are stored. This location must have a business address and a business telephone number. All ice cream mobile unit(s) must have the name, location and telephone number of the owner of the ice cream mobile unit(s) on the driver's door in lettering at least two inches in height. 2. You must furnish the City an insurance certificate with the City of Little Rock named as a certificate holder with insurance with an, insurance company authorized to do business in the State of Arkansas in an amount at least equal to the minimum motor vehicle insurance requirement for the State of Arkansas. 3. You must provide a copy of your Arkansas sales tax permit along with a copy of your most recent Arkansas Sales Tax Report. 4. Your ice cream mobile unit(s) must be equipped, on the drivers' side, with a mechanically operated safety swing -out arm per safety swing -out arm diagram with specifications. The top of the safety swing -out arm must be at least four feet from the ground and attached to the ice cream mobile unit behind the drivers door and is to be mechanically extended whenever the ice cream mobile unit is stopped to make a sale. 5. Your ice cream mobile unit(s) must be equipped with two flashing lights on the top rear of the unit at least 6 inches in diameter that must be flashing whenever the ice cream mobile unit is selling ice cream. 6. Your ice cream mobile unit(s) must be equipped with mirrors on the front and rear of the vehicle that give the driver when sitting a clear view of the front and back along with the passenger side of the ice cream mobile unit. 7. Your ice cream mobile unit(s) must have signage on the front of the vehicle clearly identifying the unit as an ice cream truck along with the words [PAGE 3 OF 51 0 0 CHILDREN CROSSING at least 3 inches in height! On the driver side of the ice cream mobile unit there must be signage alerting all customers that all sales must be made from the curb side of the vehicle. On the passenger door of the unit there must be signage at least 1 inch in height with the words WATCH FOR CARS — CROSS AT REAR. On the rear of the vehicle there must be signage with the words CAUTION CHILDREN CROSSING at least 3' /z inches in height along with a sign with the word SLOW at least 4 inches in height. 8. All ice cream mobile units must meet or exceed Health Department requirements. [PAGE 4 of 51 (itib S OPERATING RULES FOR LICENSED ICE CREAM MOBILE UNITS 1. Ice cream mobile units are prohibited from operating before 11:00 A.M. and after one half hour after sunset Monday through Saturday. On Sunday, ice cream mobile units are prohibited from operating before 12:00 noon and after one half hour after sunset. 2. Ice cream mobile units must make all sales from the curbside of the vehicle and must be legally parked at the curb. The mechanically operated safety swing-out arm must be extended whenever the unit is stopped making a sale and the lights on the top rear of the ice cream mobile unit must be flashing whenever the ice cream mobile unit is selling ice cream. 3. Ice cream mobile units cannot make or attempt to make sales within 500 feet of any school while such school is in session unless invited onto school property by school officials. 4. Ice cream mobile units are prohibited from making or attempting to make sales within 500 feet of any church while such church is in session unless invited onto church property by church officials. 5. Ice cream mobile units can only make or attempt to make sales on public streets that are primarily residential streets where the speed limit is 30 mph or slower. 6.
