3 AN ORDINANCE TO VACATE AND ABANDON PORTIONS
4 OF THE BRACK AVENUE, CARL STREET AND LUCIE STREET
5 RIGHTS -OF -WAY, AND THE ALLEY RIGHT -OF -WAY WITHIN
6 BLOCK 25, BRACK ADDITION, IN THE CITY OF LITTLE
7 ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to abandon portions of the Brack Avenue, Carl
10 Street and Lucie Street rights- of -%vay, as well as the alley right -of -way within Block 25,
11 Brack Addition, pursuant to the City's general police power authority under Ark. Code
12 Ann. § 14 -54 -104;
13 WHEREAS, the Board has determined that the abandoning of this portion of the
14 public right -of -way will not have an adverse impact on the adjacent property owners
15 nor the local traffic, and therefore, the right -of -way abandoned by this ordinance is no
16 longer needed for corporate purposes except as otherwise noted below.
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
18 OF THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons the
20 portion of the said right of way, together with the right of public in general, in and to
21 the portion of Brack Avenue, Carl Street and Lucie Avenue, and the alley right -of -way
22 within Block 25, Brack Addition, in the City of Little Rock, Pulaski County, Arkansas.

I Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed
2 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of
3 Pulaski County, Arkansas.
4 Section 3. Severability. In the event any title, section, paragraph, item,
5 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
6 or unconstitutional, such declaration or adjudication shall not affect the remaining
7 portions of the ordinance which shall remain in full force and effect as if the portion so
8 declared or adjudged to be invalid or unconstitutional was not originally a part of the
9 ordinance.
10 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
11 that are inconsistent with the provisions of this ordinance are hereby repealed to the
12 extent of such inconsistency.
