3 A ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 2-
4 243 (1988) TO RECOGNIZE PROPERTY AND CASUALTY
5 INSURANCE CONSULTANT SERVICES AS A PROFESSIONAL
6 SERVICE FOR THE CITY OF LITTLE ROCK, ARKANSAS, AND FOR
7 ITS VARIOUS BOARDS AND COMMISSIONS; AND FOR OTHER
8 PURPOSES.

10 WHEREAS, Act 429 of 1995 was effective February 24, 1995, and
11 WHEREAS, such act expands the scope of Ark. Code Ann. § 19 -11 -801 (Michie
12 Repl. 1998) regarding the designation of professional services, and
13 WHEREAS, Act 429 authorizes a political subdivision to include as professional
14 services such consulting services as the political subdivision shall designate by two -
15 thirds (2/3) vote of its governing body, and
16 WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, finds that
17 price or cost bidding for the provision of the services of a property and casualty
18 insurance consultant to develop the Request for Proposal for the City's property and
19 casualty insurance coverage and review the bids received is impracticable, unfeasible,
20 or, if based solely on price, would result in an outcome that would not meet the best
21 interests of the City, and
22 WHEREAS, for the services of a property and casualty insurance consultant, this
23 declaration on an ongoing basis is appropriate.
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
25 OF THE CITY OF LITTLE ROCK ARKANSAS:

1 Section 1. Little Rock, Ark., Rev. Code § 2- 243(a)(2) (1988) is hereby amended to
2 add subsection (s) to read as follows:
3 (2) All services declared to be a professional service if done for or on
4 behalf of the City, its boards, commissions or authorities, including the
5 following:
6 (s) property and casualty insurance consultant.
7 Section 2. Severability. In the event any portion of this ordinance is declared or
8 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
9 affect the remaining portions of this ordinance, which shall remain in full force and
10 effect as if the portion so declared or adjudged invalid or unconstitutional was not
11 originally a part of this ordinance.
12 Section 3. Repealer. All ordinances and resolutions, and parts thereof, which
13 are in conflict with any provision Of this ordinance are hereby repealed to the extent of
14 such conflict.
