In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. After receiving encouragement from you that the following amendment would most likely receive a favorable reception, I amend my rezoning request as follows: Multifamily parcels 3,4,5, and 7 are hereby withdrawn from the application, leaving this area zoned as before. Multifamily parcel 6, previously 24 acres in size, is reduced to 17.13 acres in size in accordance with the attached plat and the zoning request is changed to MF 18. All other portions of my rezoning request remain unchanged from the original application that came to the Board from the Planning Commission with a 10 -0 vote. Parcel 6 at 17.13 acres and MF 18 represents an exact swap of the existing amount of acreage that I already have at MF 18. Thus, this change does not increase the number of multifamily units I will have and therefore does not increase the number of units for which the fire department is presently responsible. The new multifamily area is, in fact, closer to the existing fire station than the original multifamily tract. The new 17.13 acre multifamily tract is approximately 800' off Cantrell on a parcel of land that is completely surrounded by my land and is therefore not visible to travelers on the Highway 10 corridor whereas the existing 17.13 multifamily tract fronts on Chenal and Highway 300 and is thereby unavoidable by my opponents coming to and from Little Rock from their rural environs. 02/12/04 THU 22:40 [TY /R.Y NO 90SS] .. -- ..+� ♦a apt+ oene ana.Linda Pfeifer 5018685252.
