Whereas, a request was made to abandon a portion of Industrial Drive and Shall Street located in Blocks 2, 5 and 6 of Wiggin's and Yonley Addition, pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; Whereas, the Board has determined that the abandoning of this portion of the public right -of -way will not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed for corporate purposes except as otherwise noted below. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby releases, vacates, and abandons the portion of the said right of way, together with the right of public in general, in and to the portion of Industrial Drive and Shall Street located in Blocks 2, 5 and 6 of Wiggiri s and Yonley Addition, in the City of Little Rock, Pulaski County, Arkansas. Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed 23 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of 24 Pulaski County, Arkansas. 25 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same 6 that are inconsistent with the provisions of this ordinance are hereby repealed to the 7 extent of such inconsistency. 8 Section 5. Emergency. The City has worked diligently to complete the work on the 9 William Jefferson Clinton Presidential Park, and to accommodate the location of the Heifer 10 International headquarters within the City because it is believed that these facilities, located in 11 close proximity of each other, will benefit the public health, safety and welfare through 12 innovative programs, educational opportunities, the enhancement of park property and property 13 that was not being used to its maximum potential, and the opportunity to spur economic growth 14 in the east Little Rock area, further, the City can cooperate with Heifer International to help 15 secure favorable funding and financial opportunities by the abandonment of this right -of -way; an 16 emergency is, therefore, declared to exist and this ordinance will be in full force and effect from 17 and after the date of its passage. 18 PASSED: January 20, 2004 19 ATTEST: 20 22 N can y Wood, City Clerk 23 24 APPROVED AS TO LEGAL FORM: 25 26 °V A`er� k ' � 27 Thomas M.
