3 AN ORDINANCE TO AMEND LITTLE ROCK ORDINANCE NO.
4 18,842 (MARCH 18, 2003) AND TO REPLACE IT IN ITS ENTIRETY
s WITH THE FOLLOWING GUIDELINES FOR THE PRESIDENTIAL
6 PARK OVERLAY DISTRICT; TO CODIFY IN CHAPTER 36 OF THE
7 LITTLE ROCK CODE OF ORDINANCES; AND FOR OTHER
8 PURPOSES.

10 WHEREAS, the Board of Directors established a William Jefferson Clinton
11 Presidential Park Overlay District ( "PPO ") in Little Rock, Ark., Ordinance No. 18,842
12 (March 18, 2003) ( "LRO 18,842 "), and
13 WHEREAS, since passage of LRO 18,842 a detailed review of the design standards
14 for the area has been undertaken and has resulted in the following recommended
15 language, and
16 WHEREAS, the City of Little Rock wishes to encourage the redevelopment of
17 the areas surrounding the William Jefferson Clinton Presidential Park and the site of the
18 Heifer International headquarters, and,
19 WHEREAS, the Little Rock Planning Commission after review at a public
20 hearing October 30, 2003, recommended the design standards proposed in the PPO to
21 guide future redevelopment of these areas.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
23 OF THE CITY OF LITTLE ROCK, ARKANSAS:
24 Section 1. LRO No. 18,842 adopted March 28, 2003, is hereby amended in its
25 entirety, replaced with the following language: a �' cf,,T

I The purpose of the Presidential Park Overlay (District) is to create a
2 quality vital atmosphere for businesses (commercial or office) and
3 residents. Buildings, parking areas, signage, landscaping and street
4 furnishings should all be designed to complement and encourage
5 pedestrian use both day and evening. Proper planning is necessary to
6 avoid visual clutter.
7 Guidelines and strategies must be in place to protect the District
8 from the negative impact of poorly planned or incompatible projects.
9 Incompatible development has the potential to destroy the attributes that
10 will attract people to the District.
11 B. BOUNDARIES:
12 The District shall include all parcels within the area described
13 below: starting at Interstate 30 and the Arkansas River east along the
14 River to 150 feet east of Bond Street; thence south to 6th Street; hence west
15 to Bond; hence south 150 feet; hence west to a line 150 feet east of College
16 Street; hence south to a line 150 feet south of 9th Street; hence west to
17 Interstate 30; hence north to the point of beginning.
18 C. APPLICATION OF REGULATIONS:
19 (a) The regulations of this District shall be in addition to and shall overlay all
20 other zoning districts and other ordinance requirements regulating the
21 development of land so that any parcel of land lying in the overlay
22 District shall also lie within one or more of the other underlying zoning
23 districts. Therefore, all property within this overlay District shall have
24 requirements of both the underlying and overlay zoning districts in
25 addition to any other provisions regulating the development of land. In

1 case of conflicting standards between this article and other City
2 ordinances, the overlay requirements shall control.
3 (b) These regulations shall apply to new development, redevelopment of
4 existing buildings the cost of which exceeds 50 percent of the buildings'
5 current replacement value or expansion of existing development. The
6 design guidelines shall be implemented when a permit is requested for
7 exterior improvements on buildings or in the public right -of -way.
8 Routine repairs, maintenance and interior alterations shall not require
9 compliance with this section.
to (c) Uses, structures or lots which existed on the effective date of this
11 ordinance which do not conform to the standards and guidelines
12 established in this ordinance, shall be treated as nonconforming according
13 to the provisions of Article III of chapter 36, Little Rock Code of
14 Ordinances. Nonconforming status shall not apply to construction of
15 improvements in the public right -of -way required by the City,
16 redevelopment or expansion of existing development.
17 D. SIDEWALKS AND LANDSCAPE:
18 All landscape requirements of the base zone shall be enforced,
19 related to location, plant size and spacing. Along Bond, 3rd, 6th, 9th, and
20 College Streets, all the standards delineated below apply in Urban Use
21 (UU) zoned areas the Street trees below apply. Any property owner, due
22 to the spacing requirements, not required to provide a 'street tree' or
23 street furniture' shall pay an in -lieu fee based on the percentage of
24 frontage along the street divided by the cost of providing the required
25 Street trees and furniture in the ordinance. See schedule for base costs.

6 II. Street Furniture:
7 Benches and Receptacles shall be at a spacing of 100 feet
8 with none closer than 50 feet to the intersection.
9 Street furniture shall be:
10 • Bench: DuMor Bench 51 or approved equivalent
11 • Receptacle: DuMor Receptacle 152 or approved
12 equivalent
13 E. VEHICULAR USE AND SERVICE AREAS:
14 I. In order to conserve our natural resources and minimize
15 flooding and pollution due to large amounts of impermeable
16 surfaces, vehicular use areas may be surfaced with porous
17 materials. Vehicle use areas that are made of porous materials
18 must be low use, specifically may not be loading areas, primary
19 parking areas, driveways, etc. The Plans Development
20 Administrator must approve any alternative surface treatment, to
21 that described in Section 36 -508 at the time of building permit
22 review.
23 II. Service and loading areas shall not be located along 3rd
24 Street from Interstate 30 East for 1150 feet, 6th Street, Bond Street or
25 College /College Street extension. Delivery vehicles (such as beer,
26 soft drink, etc. trucks) may make deliveries on these streets.

1 F. USE REGULATIONS:
2 Permitted Uses:
3 a) All uses in the base zone classification
4 b) Outdoor, on- premise, seating areas for dining in UU areas
5 G. HEIGHT REGULATIONS:
6 No building hereafter erected or structurally altered shall exceed 35
7 feet in the area east of John Street.
8 Any development in the area between John and McLean Streets
9 erected or structurally altered shall not exceed the base height of 45 feet;
10 except, that the height may be increased as follows:
11 Developments, which provide a minimum 40 percent of the
12 gross floor area for residential uses, are entitled to add thirty (30)
13 feet. If at least 50 percent of the street -level office and retail space
14 has direct access to the street, an additional fifteen (15) feet may be
15 added to the structure. Building height in this section is cumulative
16 not to exceed ninety (90) feet.
17 H. SETBACKS:
18 Setback shall be that of the base zoning except:
19 a) Bond Street, 8th Street, 9th Street, and McLean Street south
20 of 7th Street where all structures shall be setback fifteen (15)
21 feet from the street right -of -way.
22 b) John Street, where all structures shall be setback twenty (20)
23 feet from the street right -of -way.
24 I. PARKING:
25 No surface parking is allowed along 3rd Street from I -30 east 1150
26 feet, 6th Street, Bond Street and College /College Street Extension. Parking

I structures along these streets must either have non - vehicular uses on the
2 first (ground) level or a false fagade along the street so as to appear to be a
3 non - vehicular use area.
4 J. SIGNAGE:
5 I. General sign regulations as per the base zoning classification
6 except for the first two floors where the following is required:
7 (a) Awning valances are appropriate locations for
8 signage, sign area not to exceed six (6) square feet of
9 valance.
10 (b) Neon illumination is permitted if channelized.
11 (c) Letters shall not exceed 30 inches in height.
12 (d) Window signs shall not cover more than twenty-five
13 percent of each glass panel.
14 K. EXCEPTIONS:
15 Property that cannot be developed, for any reason, without
16 violating the standards of this article shall be reviewed through the
17 Planned Zoning District (PZD) section of the zoning ordinance, with the
18 intent to devise a workable development plan which is consistent with the
19 purpose and intent of the overlay standards.
20 Section 2. Severability. In the event any title, section, paragraph, item,
21 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
22 or unconstitutional, such declaration or adjudication shall not affect the remaining
23 portions of the ordinance which shall remain in full force and effect as if the portion so
24 declared or adjudged to be invalid or unconstitutional was not originally a part of the
25 ordinance.

Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance, including but not limited to
the provisions of Little Rock, Ark., Ordinance No. 18,842 (March 18, 2003) are hereby
repealed to the extent of such inconsistency.
