HomeMy WebLinkAbout190322004005568 . 01/20/2004 12:42:18 PH • Filed 8 Recorded in Official Records of CAROLYN STALEY PULASKI COUNTY ORDINANCE NO. 19,032 CIRCUIT /COUNTY CLERK Fees f14.% AN ORDINANCE TO AMEND ORDINANCE NO. 16,968 TO ALLOW FOR THE INSTALLATION OF SELF - OPENING AND CLOSING GATES FOR THE ENTRANCES OF OTTER CREEK SUBDIVISION; AND FOR OTHER PURPOSES Whereas, Ordinance No. 16,968, which was passed by the Board of Directors in September, 1995, permitted the installation of a security gate across Wimbledon Loop in the Otter Creek Subdivision, and Whereas, the said ordinance provided for the closure of the gate between the hours of 10:00 p.m. and 6:00 a.m. daily and said closure has caused no adverse effects to the residents, and Whereas, the Board of Directors of the Otter Creek Homeowners Association has requested approval of the installation of a self - opening and closing gates across Otter Creek Boulevard and Wimbledon Loop to slow traffic through the area and thereby create a safer neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Ordinance No. 16,968 is hereby amended to allow the installation of self - opening and closing gates across Otter Creek Boulevard and Wimbledon Loop in the Otter Creek Subdivision. Section 2. No access is to be denied to the traveling public. The gates are to open automatically as vehicles approach and close when the vehicles clear. To prevent excessive delay to the traveling public, gates are to remain open during peak morning and afternoon traffic periods. Times the gates are to remain open are subject to review and approval by the City Manager. Section 5. The Otter Creek Home Owners Association will obtain all necessary permits and plan approvals prior to construction. Section 6. The franchise will remain in effect unless modified or revoked by the Board. The franchise is granted for a period of ten (10) years following the effective date of this ordinance, and may be extended by the City Manager for additional five (5) year terms thereafter. Section 7. Severability. In the event any title, section, paragraph, item, 7sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
