BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zone classification of the following property be and is hereby changed as indicated: Z -7517 — Part of the SE %4 of the SW Y4; and part of the SW '/4 of the SE 1/4, all in Section 8, T -2 -N, R -14 -W, Pulaski County, Arkansas, more particularly described as follows: Commence at the SE corner of said SE '/4 SW '/4 of Section 8; thence S89 °10' West 124.5; thence NO2 °51'32" West, 164.0 feet to the point of beginning of the herein described tract of land feet; thence S89 °10' West, 393.5 feet; thence NO °11'30" West, 207.1 feet; thence N40 °09'38" East, 586.22 feet to the Southerly right -of -way line of State Highway Number 10; thence S49'16'22" East along said right - of -way line 90 feet from and parallel with the centerline of said highway a distance of 458.47 feet to the centerline of Ferndale Cut -Off Road; thence along said centerline being a curve to the left for the following chord bearings and distances: S23 °22'23" West, 69.0 feet; S18 °46' West, 97.3 feet; S11 °00' West, 96.65 feet; S03 °27' West, 96.47 feet; thence run S89 °10' West, 248.47 feet to the point of beginning, containing 7.25 acres, more or less: From "R -3" Single Family District to "C -3" General Commercial District (Southwest corner of Ferndale Cut -Off Road and Highway 10). SECTION 2. That the zoning of the above described property is subject to the following condition which was proposed by the applicant for the property described in Section 1 of this ordinance and which shall be covenants running with the land to bind subsequent grantees of the property: ® Future development of the property must conform to the Highway 10 Design Overlay District Ordinance requirements. SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the changes provided for in Sections 1 and 2. hereof. SECTION 4. That the Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. 0 0 SECTION 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
