HomeMy WebLinkAbout189910 1r 1 ORDINANCE NO. 18,991 2 3 AN ORDINANCE TO ESTABLISH THE RATE OF TAXATION 4 OF PROPERTY FOR THE CITY OF LITTLE ROCK FOR THE s YEAR 2004 FOR VARIOUS FUNDS OF THE CITY OF LITTLE 6 ROCK, ARKANSAS; TO DECLARE AN EMERGENCY; AND 7 FOR OTHER PURPOSES. 8 9 WHEREAS, state law mandates that the county quorum court adopt an 10 ordinance prior to the end of the year which establishes the various millage rates for 11 assessments on real and personal property for the coming year, and 12 WHEREAS, on November 4, 2003 the voters of the City of Little Rock authorized 13 the issuance of limited tax general obligation bonds for the purpose of capital 14 improvements within the City, 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 16 OF THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. The rate of taxation of real and personal property in the City of 18 Little Rock, Arkansas for certain City purposes is hereby fixed, established and levied as 19 follows: 20 (a) For general purposes in order to carry on the affairs of the 21 City Government under Section 4, Article 12 of and Amendment 10 to the 22 Constitution of Arkansas of 1874, there is hereby levied a tax of five (5) 23 mills; 24 (b) For the purpose of paying bonds and interest as may be 25 required for the bonds authorized in Little Rock, Ark., Ordinance No 26 18,941 (September 30, 2003), to repay the City of Little Rock, Arkansas, [PAGE 1 OF 31 ORDINANCE Rate of Little Rork Property Tax for 2001 • 0 1 Capital Improvement Bonds, approved at a special election held on 2 November 4, 2003, there is hereby levied a tax of three and three tenths 3 (3.3) mills; 4 (c) For the purpose of paying Policemen's Pensions in 5 accordance with provisions of Amendment No. 31 to the Constitution of 6 the State of Arkansas, a tax of one (1) mill; 7 (d) For the purpose of Paying Firemen's Pensions in accordance 8 with the provisions of Amendment No. 31 to the Constitution of the State 9 of Arkansas adopted November 5, 1940, and Act 16 of the acts of the 10 General Assembly of the State of Arkansas for the year 1941, a tax of one 11 (1) mill; 12 (e) For the purpose of maintaining the City Library, in 13 accordance with the provisions of Amendment No. 30 to the Constitution 14 of the State of Arkansas, a tax of two and eight tenths (2.8) mills; 15 (f) For the purpose of paying bonds and interest as may be 16 required for the City of Little Rock, Arkansas, for Library System Capital 17 Improvement Bonds, a tax of one (1) mill. 18 Section 2. Since the City achieved equalization in 1989 under the provisions of 19 Amendment 59 to the Arkansas Constitution, the tax rates are the same for both real 20 and personal property. 21 Section 3. Because Pulaski County completed a countywide reappraisal of 22 property in 2003, it is possible that the millage rates set forth in Section 1 of this 23 Ordinance will be subject to the rollback provisions of Amendment 59 as determined by 24 the Arkansas Assessment Coordination Department; therefore, to the extent that the 25 millage rates in Section 1 are ordered rolled back in accordance with state law, the 26 Board of Directors adopts and ratifies such millage rates. The City Clerk is hereby directed to transmit a certified copy of this 2 Ordinance to the County Clerk of Pulaski County so that the taxes recited may be 3 extended on the tax books of Pulaski County and collected with the other taxes for the 4 year 2003. 5 Section 5. Severability. In the event any title, section, paragraph, item, 6 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 7 or unconstitutional, such declaration or adjudication shall not affect the remaining 8 portions of the ordinance which shall remain in full force and effect as if the portion so 9 declared or adjudged invalid or unconstitutional was not originally a part of the 10 ordinance. 11 12 13 14 15 16 17 18 19 20 Section 6. Repealer. All ordinances and resolutions, including by not limited to Little Rock, Ark., Ordinance No. 18,798 (December 17, 2002) ( "the 2003 Budget Ordinance'), are hereby repealed to the extent of such inconsistency. Section 7. Emergency. It is essential to the public health, safety and welfare that the proper millage rates be stated each year, and that this information be promptly communicated with the Pulaski County government in order to assure that appropriate tax millages are put into effect for the following calendar year, an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage. and any necessary land acquisition and street, parking and drainage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 13,189 votes were cast FOR the issuance of bonds and 3,557 votes were cast AGAINST it, (b) the issuance of bonds in the maximum principal amount of $985,000 to finance the construction, reconstruction, acquisition, renovation, remodeling or relocation of, or improvements to, new or current police department facilities and apparatus, including particularly, without limitation, a new downtown police service center, crime detection equipment and any necessary land acquisition and street, parking and drainage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 12,976 votes were cast FOR the issuance of bonds and 3,762 votes were cast AGAINST it, (c) the issuance of bonds in the maximum principal amount of $11,865,000 to finance the reconstruction, acquisition, renovation, remodeling or relocation of, or improvements to, new or current police, fire and emergency radio system facilities and apparatus and early warning system facilities and apparatus; facilities and apparatus for a 3- 1-1 general information telephone system; and any necessary land acquisition and street, parking and drainage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 12,923 votes were cast FOR the issuance of bonds and 3,802 votes were cast AGAINST it, (d) the issuance of bonds in the maximum principal amount of $27,000,000 to finance the construction, reconstruction or acquisition of, or improvements to, new or current streets, bridges and viaducts, and any necessary intersection improvements, traffic signalizations, speed calming measures, lighting, equipment, land and easement acquisition and drainage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 12,752 votes were cast FOR the issuance of bonds and 3,915 votes were cast AGAINST it, (e) the issuance of bonds in the maximum principal amount of $4,515,000 to finance the construction or acquisition of facilities for drainage and flood control and any necessary land and easement acquisition therefor, has been filed in my office and presented to the Mayor 9 0 and reflects that 12,393 votes were cast FOR the issuance of bonds and 4,236 votes were cast AGAINST it, (f) the issuance of bonds in the maximum principal amount of $14,965,000 to finance the construction, reconstruction, acquisition, renovation, remodeling or improvements for City park and recreational facilities and apparatus, including particularly, without limitation, improvements to existing parks; development of a new park with playing fields; development of a trail system; expansion of the War Memorial Fitness Center; renovations and improvements to the Little Rock Zoo; community center upgrades; and any necessary sidewalks, land and easement acquisition and street, bridge, drainage, parking, lighting, conservation and signage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 12,041 votes were cast FOR the issuance of bonds and 4,605 votes were cast AGAINST it, (g) the issuance of bonds in the maximum. principal amount of $1,215,000 to finance school area pedestrian safety improvements, including particularly, without limitation, the construction or acquisition of sidewalks or crossing lights near various schools within the City and any necessary land and easement acquisition and street improvements therefor, has been filed in my office and presented to the Mayor and reflects that 12,400 votes were cast FOR the issuance of bonds and 4,285 votes were cast AGAINST it, (h) the issuance of bonds in the maximum principal amount of $1,360,000 to finance the construction, reconstruction, acquisition, renovation, remodeling or relocation of, or improvements to, new or current animal services facilities and apparatus, and any necessary land acquisition and street, parking and drainage improvements therefor, has been filed in my office and presented to the Mayor and reflects that 11,779 votes were cast FOR the issuance of bonds and 4,856 votes were cast AGAINST it, and (i) the issuance of bonds in the maximum principal amount of $1,145,000 to finance the reconstruction, renovation or remodeling of, or improvements to, the convention, meeting and entertainment facilities at Robinson Center and the Statehouse Convention Center, has been filed in my office and presented to the Mayor and reflects that 10,975 votes were cast FOR the issuance of bonds and 5,678 votes were cast AGAINST it. I certify that the copy of the printed ballot attached to the Certificate of Election Commissioners is a true and correct copy of the ballot used at the Special Election, a copy of which has been filed in my office. The results of the vote upon the questions submitted are as follows: OUESTION ONE: FIRE DEPARTMENT IMPROVEMENT BONDS The issuance of bonds in the maximum principal amount of $12,135,000 to finance Fire Department Improvements. The Fire Department Improvements include the construction, reconstruction, acquisition, renovation, remodeling, or relocation of, or improvements to, new or current fire department facilities and apparatus, including particularly, without limitation, the second phase of the fire training academy; and any necessary land acquisition and street, parking and drainage improvements therefor. FOR 12,923 AGAINST 3,802 OUESTION FOUR: STREET IMPROVEMENT BONDS The issuance of bonds in the maximum principal amount of $27,000,000 to finance Street Improvements. The Street Improvements include the construction, reconstruction or acquisition of, or improvements to, new or current streets, bridges and viaducts, and any necessary intersection improvements, traffic signalizations, speed calming measures, lighting, equipment, land and easement acquisition and drainage improvements therefor. FOR 12,752 AGAINST 3,915 OUESTION FIVE: DRAINAGE IMPROVEMENT BONDS The issuance of bonds in the maximum principal amount of $4,515,000 to finance Drainage Improvements. The Drainage Improvements include the construction or acquisition of facilities for drainage and flood control and any necessary land and easement acquisition therefor. FOR 12,393 AGAINST 4,236 OUESTION SIX: PARK AND RECREATIONAL IMPROVEMENT BONDS The issuance of bonds in the maximum principal amount of $14,965,000 to finance Park and Recreational Improvements. The Park and Recreational Improvements include the construction, reconstruction, acquisition, renovation, remodeling or improvements for City park and recreational facilities and apparatus, including particularly, without limitation, improvements to existing parks; development of a new park with playing fields; development of a trail system; expansion of the War Memorial Fitness Center; renovations and improvements to the Little Rock Zoo; community center upgrades; and any necessary sidewalks, land and easement acquisition and street, bridge, drainage, parking, lighting, conservation and signage improvements therefor.
