AN ORDINANCE TO AMEND CHAPTER 17, ARTICLE II OF THE
LITTLE ROCK CODE, 1988, TO ADD CERTAIN BUSINESS
CLASSIFICATIONS TO THE SCHEDULE OF BUSINESS LICENSE
FEES; AMENDING THE DUE DATE FOR PAYMENT OF BUSINESS
LICENSE FEES FOR 2004, AND FOR OTHER PURPOSES.
WHEREAS, new business classifications are needed in order to have specific
classifications and fees for these businesses and professions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. Section 17 -52 of the Little Rock City Code, 1988, is hereby amended to
add the following business classifications and fees:
158.1 Music Educators/Home Based
1 — 20 students
21 or more students
198.1 (a)Schools, Tutoring Service
(b)Schools, Tutoring Service/
Home Based
1— 20 students
21 or more students
Base Fee Variable Fee
No license required
$100 $20 per employee
$200 $30 per employee

Section 2. Section 17 -45(5) of the Little Rock City Code, 1988, is hereby amended as

(5) Business taxes payable in 2004 are due January 31, 2004, if
paid annually. The proprietor shall have the option of paying

1 the annual tax in two (2) equal installments on January 31,
2 2004 and July 1, 2004.
3 Section 3. The City Clerk shall publish this ordinance one time in a local newspaper
4 no later than one (1) week after the passage of the ordinance, as required in Ark. Code Ann.
5 § 26 -77 -104 (Michie Repl. 2000 & Supp. 2003).
6 Section 4. Repealer. All ordinances and parts of ordinances that conflict with this
7 ordinance are hereby repealed to the extent of such inconsistency.
8 Section 5. Severability. In the event that any title, section, item, sentence, clause,
9 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional,
10 such declaration or adjudication shall not affect the remaining portions of the ordinance
11 which shall remain in full force and effect as if the portion so declared or adjudged invalid
12 or unconstitutional was not originally a part of the ordinance.
13 Section 6. Emergency. The Board of Directors has previously declared that the
14 collection of business license fees is necessary for the performance of essential municipal
15 functions and that, without the same, the delivery of City services will decrease, and the
16 City's ability to provide and support the public peace, health and safety will be diminished.
17 To ensure that licensees receive their tax statements in time to meet the January fee
18 collection deadline, this ordinance should be given effect immediately. An emergency is,
19 therefore, declared to exist and this ordinance shall be in full force and effect from and after
20 the date of its passage.
