HomeMy WebLinkAbout18936I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 041 24 25 26 27 28 29 30 31 32 33 34 0 ORDINANCE NO.18,936 AN ORDINANCE TO APPROPRIATE $72,000 FOR THE LOCAL INITIATIVES SUPPORT CORPORATION (LISC) TO PROVIDE LOW TO MODERATE HOUSING ASSISTANCE; TO DECLARE IT IMPRACTICAL AND UNFEASIBLE TO ENGAGE IN A COMPETITIVE SELECTION PROCESS; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the Board of Directors has decided to participate in programs that provide housing assistance to low to moderate income person, but are limited in what can be done because of restrictions contained in the Arkansas Constitution, and WHEREAS, such participation fulfills a public purpose since the maintenance and increase of housing stock improves the real estate and personal property tax roles, makes a neighborhood a more desirable place to live and, in the process, helps to alleviate urban blight and decrease crime, and overall helps to promote social and economic development within the City, and WHEREAS, the Local Initiative Support Corporation ( "LISC ") is a national organization that has maintained and operated a local office in Little Rock for a number of years, helps to channel money to Community Development Corporations ( "CDC "), and obtains substantial grants from such local corporations as the Levi Strauss Foundation, Pulaski Bank, Stephens, Inc., the Bank of America, Citizen's First Bank, Eagle Bank and Trust Company, Entergy Corporation, Metropolitan National Bank, One National Bank, Pinnacle Bank, and Regions Bank, and WHEREAS, by entering into an agreement with the LISC, the City is able to enhance its ability to promote low to moderate income housing assistance since it can obtain the benefit of the grant funds outlined above, a benefit available only to the Little Rock LISC, and thus constitutes a situation which makes it impractical and unfeasible to bid, and WHEREAS, as a part of the 2003 budget process, the City budgeted seventy-two thousand dollars ($72,000) to cooperate with the LISC in these endeavors, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Manager is authorized to enter in to an agreement with the Local Initiatives Support Corporation, a New York not - for -profit corporation, in a form acceptable to the City Attorney, to provide low to moderate income housing assistance to Little Rock citizens, to use the donated monies that LISC receives from various local corporations, and to receive an amount not in excess of seventy-two thousand dollars ($72,000) from the City for these services. Because the LISC, which provides major assistance to various CDCs located within 2 the City, receives substantial donations from local businesses that can be matched with the City's money 3 to enhance this housing program, the Board finds that it is impractical and unfeasible to submit these 4 services to competitive bidding and, therefore, waives this requirement. 5 Section 3. Severability. In the event any section, paragraph, item, sentence, clause, phrase, or 6 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions or the ordinance which shall remain in full force an 8 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally part of the 9 ordinance. 10 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 11 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. 12 Section 5. Emergency. The ability to continue to provide meaningful housing assistance to low 13 to moderate income families is essential to preserve the public health, safety and welfare, particularly 14 since such assistance promotes neighborhood development, increases property tax collections for the 15 City, decreases crime, and enhances social and economic development within the community; therefore, 16 this ordinance needs to become immediately effective in order to assure there is no gap or delay in the 17 ability of the Little Rock LISC, or the City, to provide these services; and emergency is, therefore, 18 declared to exist and this ordinance shall be in full force and effect from and after the date of its passage. 19 20 PASSED: September 16, 2003 21 22 ATTEST: 23 /�� 24 �(t�Gvicr (JL1 cbtl 25 Nataki oBl eker, Assist.
