AN ORDINANCE TO ESTABLISH TAYLOR LOOP MUNICIPAL
MULTI- PURPOSE PROPERTY OWNERS IMPROVEMENT
DISTRICT NO. 19 OF LITTLE ROCK, ARKANSAS; NAMING
THE COMMISSIONERS TO THE BOARD OF
COMMISSIONERS; DECLARING AN EMERGENCY; AND FOR
OTHER PURPOSES.
10 Whereas, parties claiming to be the owners of record as reflected by the deed
I I records in the Office of the Circuit Clerk and Ex Officio Recorder of Pulaski County
12 Arkansas, of real property located within the territory hereinafter described, filed their
13 petition on August 19, 2003, with the Little Rock City Clerk praying that an
14 improvement district be established for the purposes hereinafter set out; and
15 Whereas, the petition being one for the formation of a municipal property
16 owners improvement district and having received certification from American Abstract
17 and Title Company that the subscribers to the petition constitute all the owners of
18 record title of the real property located within the territory hereinafter described, no
19 further notice is required pursuant to law; and
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
21 OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. There is hereby established the Taylor Loop Municipal Multipurpose
23 Property Owners Improvement District No. 19 of Little Rock, Arkansas, which

1 Part of the NET /4, NEl /4 and the SE1 /4, NE1 /4, Section 24, Township 2 North, Range
2 14 West, City of Little Rock, Pulaski County, Arkansas, more particularly
3 described as follows:
4 Beginning at the SW corner of the NET/4, NET/4, Section 24, Township 2 North,
5 Range 14 West; thence North 01'34'57" East for a distance of 446.39 feet to a
6 point on the 10 -year floodway line; thence along said 100 -year floodway line the
7 following bearings and distances; South 88 °23'02" East for a distance of 372.06
8 feet; North 79 °55'57" East for a distance of 196.59 feet; South 85 °16'49" East for a
9 distance of 102.78 feet; South 75 °52'18" East for a distance of 261.44 feet; South
10 59 °22'32" East for a distance of 50.00 feet, thence South 01'37'28" West for a
11 distance of 396.58 feet to a point; thence South 89 °05'52" East for a distance of
12 15.13 feet to a point; thence South 15 °41'41" West for a distance of 203.92 feet to a
13 point; thence South 66 °27'39" East for a distance of 58.28 feet to a point; thence
14 South 22 °51'10" West for a distance of 115.26 feet to a point; thence South
15 41 °24'08" East for a distance of 76.21 feet to a point; thence South 54 °57'13" West
16 for a distance of 114.70 feet to a point; thence South 18 °29'43" West for a distance
17 of 81.61 feet to a point; thence South 87 °37'14" West for a distance of 219.34 feet
18 to a point; thence North 02 °07'35" East for a distance of 117.26 feet to a point;
19 thence North 87 °34'10" West for a distance of 243.48 feet to a point; thence North
20 01'39'15" East for a distance of 210.05 feet to a point; thence South 87 °11'28" East
21 for a distance of 34.31 feet to a point; thence North 03 °03'03" East, a distance of
22 212.10 feet to a point; thence North 88 °29'38" West for a distance of 458.51 feet to
23 the Point of Beginning, containing 15.751 acres, more or less,
24 for the following purposes:
25 A. To acquire by purchase (by contract or eminent domain) or gift, or to
26 construct either within or without the boundaries of the district, if the
27 property within the district will be benefited thereby, a sanitary
28 waterworks distribution system, including if necessary a source, treatment
29 and distribution system, and all other appurtenances necessary or useful
30 and convenient for the operation and maintenance of such system,
31 including the rights -of -way essential thereto; within and outside the
32 boundaries of the district, and, to construct such other improvements,
33 directly or indirectly connected therewith, as may be required by the City
34 of Little Rock or the County of Pulaski and other governmental authorities
35 as prerequisites or conditions to lawfully and properly complete the
36 intents and purposes of the district; and

38 If deemed advisable and in accordance with applicable laws, to have the
39 right, but not an obligation, to connect the system to the waterworks

1 system of the City of Little Rock, or other municipality, association or
2 improvement district by the acquisition or construction of proper water
3 lines, either within or without the boundaries of the district, if a
4 reasonable and realistic opportunity to do so should develop and if the
5 property within the district will be benefited thereby; and

7 B. To acquire by purchase (by contract or eminent domain) or gift, or to
8 construct, either within or without the boundaries of the district, if the
9 property within the district will be benefited thereby, a sewage collection
10 system and a sewage treatment plant, intercepting sewers, outfall sewers,
11 force mains, pumping stations, ejector stations, and all other
12 appurtenances necessary or useful and convenient for the collection and
13 treatment, purification and disposal of industrial or domestic sewage,
14 including the rights -of -way essential thereto, within and outside the
15 boundaries of the district; and to construct such other improvements,
16 directly or indirectly connected therewith, as may be required by the City
17 of Little Rock or the County of Pulaski and other governmental authorities
18 as prerequisites or conditions to lawfully and properly complete the
19 intents and purposes of the district; and

21 If deemed advisable and in accordance with applicable laws, to have the
22 right, but not an obligation, to connect the system to the wastewater
23 system of the City of Little Rock or other municipality, association or
24 improvement district by the acquisition or construction of the proper
25 sewage lines, either within or without the boundaries of the district, if a
26 reasonable and realistic opportunity to do so should develop and if the
27 property within the district will be benefits thereby; and
28
29 To operate and maintain any such wastewater system and facilities.

31 C. To acquire by purchase (by contract or eminent domain) or gift and to
32 construct, operate, supervise, maintain and replace within and outside the
33 district recreational and common areas and facilities related thereto,
34 including but not limited to, green areas, landscaped areas, district
35 lighting improvements, street lighting improvements, playground
36 facilities, water way or wet area construction, swimming pools and tennis
37 courts, as the Board of Commissioners should subsequently decide, along
38 with access easements thereto, and other improvements necessary or
39 desirable to enhance the use and benefits of such areas and improvements,

1 within and beyond the boundaries of the district, to obtain its desired
2 effect.

4 D. To acquire by purchase (by contract or eminent domain) or gift and to
5 construct, operate, supervise, maintain and replace, within and outside
6 the district, facilities for drainage, facilities for gas pipelines, facilities for
7 underground trenches and excavations necessary for the installation by
8 public utilities or municipal utilities of electric and telephone distribution
9 systems, together with facilities related to any of the foregoing, to serve
10 the inhabitants of the district and constructing such facilities, areas and
11 improvements beyond the boundaries of the district to obtain their
12 desired effect.

14 E. To grade, drain, pave, curb, gutter and otherwise construct streets, roads
15 and highways and laying sidewalks and to operate and maintain such
16 improvements, either within or without the boundaries of the district if
17 the property within the district will be benefited thereby.

19 F. To accomplish any and all other purposes authorized by law, specifically
20 including but not limited to those intents and purposes stated in Ark.
21 Code Ann. X14 -94 -101, et seq.
22
23 Section 2. The above purposes are to be accomplished in the manner and of the
24 materials that the commissioners of the district shall deem to be in the best interest of
25 the district.
26 Section 3. The cost of the project shall be assessed upon the real property of the
27 district according to the benefits received.
28 Section 4. Abe S. Rosen, G.L. 'Bill" Bosley, and Jack Wilson, who are the owners
29 of real property or are representatives of such owners within the district, are hereby
30 named and confirmed as commissioners of, and shall compose the board of
31 commissioners of, the district.
32 Section 5. The cost incurred by the district in pursuit of the purposes herein
33 authorized and as authorized by Arkansas law shall be assessed upon the real property
34 within the district according to the benefits received.

1 Section 6. The district shall not cease to exist upon the construction or
2 acquisition of the planned improvements, but shall continue to exist for the purposes of
3 operating, maintaining and preserving the improvements, replacing equipment, paying
4 salaries and costs and performing any other functions or services authorized by law.
5 Section 7. The district may be dissolved by the commissioners when its
6 obligations are paid and the ownership, operation and maintenance of the
7 improvements, together with the appurtenances thereto, are assumed by a municipality
8 or other entity deemed appropriate by the commissioners; or the continuation of the
9 district is no longer considered necessary by the commissioners for any other reason.
10 Section 8. Severability. In the event any title, section, paragraph, item,
11 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
12 or unconstitutional, such declaration or adjudication shall not affect the remaining
13 portions of the ordinance which shall remain in full force and effect as if the portion so
14 declared or adjudged invalid or unconstitutional was not originally a part of the
15 ordinance.
16 Section 9. Repealer. All ordinances, resolutions, bylaws, and other matters
17 inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
18 Section 10. The formation of the district and the improvements planned thereby
19 are essential to the continued health, safety, growth and well being of persons within
20 the City of Little Rock and the formation of the district and the purposes of the district
21 can be accomplished only by the passage of this ordinance. Therefore, an emergency is
22 declared to exist and this ordinance, being necessary for the preservation of the public
23 peace, health and safety, shall be in full force and effect upon its passage and approval.
