HomeMy WebLinkAbout189122003079760 0811112003 08:30:52 AH • • Filed 8 Recorded in Official Records of CAROLYN STALEY PULASKI COUNTY ORDINANCE NO. 18,912 •CIRCUIT /COUNTY CLERK Fees $20.00 AN ORDINANCE REPEALING ORDINANCE NO. 18,718, REVOKING A PLANNED ZONING DISTRICT TITLED STORTZ SHORT -FORM PCD (Z -7233; REPEALING ORDINANCE NO. 18,335, REVOKING A PLANNED ZONING DISTRICT TITLED COMMERCIAL DEVELOPMENT ASSOCIATES SHORT -FORM PCD (Z- 6629 -A); AND APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED UNIVERSITY HEIGHTS SHORT -FORM PCD (Z- 7421) LOCATED ON THE SOUTHEAST CORNER OF UNIVERSITY AVENUE AND "C" STREET, IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. WHEREAS, Ordinance No. 18,718 was passed on July 16, 2002 establishing a planned zoning district titled Stortz Short-form PCD; and WHEREAS, Ordinance No. 18,335 was passed on August 29, 2000 establishing a planned zoning district titled Commercial Development Associates Short-form PCD; and WHEREAS, the owner of the subject property has requested the repeal of the "PZD" ordinances and approval of a new PCD. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 18,718 is hereby repealed, removing from the official zoning map the classification PCD — Planned Commercial Development titled Stortz Short-form PCD located at 219 North University Avenue. SECTION 2. That Ordinance No. 18,335 is hereby repealed, removing from the official zoning map the classification PCD — Planned Commercial Development titled Commercial Development Associates Short-form PCD located on the Southeast corner of University Avenue and "C" Street. SECTION 3. That the following described property is hereby zoned PCD: Lot A and B Merle Replat of Part of Lot 15, Howard Adams Subdivision and part of Lot 15, Howard Adams and R.D. SECTION 4. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 5. That the change in zoning classification contemplated for University Heights Short-form PCD is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the changes provided for in Sections 1, 2 and 3 hereof. SECTION 7. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 8. Severabiliry. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
