HomeMy WebLinkAbout18871I ORDINANCE NO. 18,871 2 3 AN ORDINANCE TO CREATE AND ESTABLISH THE CITY OF LITTLE 4 ROCK NEIGHBORHOOD AUDIT AND COMPLIANCE COMMITTEE; 5 TO ESTABLISH MONTHLY REPORTING TO SAID OVERSIGHT 6 COMMITTEE OF EXPENDITURE OF THE EXPENDITURE OF FUNDS 7 FROM CERTAIN SALES AND USE TAXES; AND FOR OTHER 8 PURPOSES. 9 10 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 11 OF THE CITY OF LITTLE ROCK, ARKANSAS: 12 Section 1. There is hereby created and established the City of Little Rock 13 Neighborhood Audit and Compliance Committee (the "Committee'), which shall have 14 oversight of the expenditure of public money collected pursuant to a one -half of one 15 percent (0.5 %) local sales and compensating use tax authorized by Little Rock, Ark., 16 Ordinance No. 18,864 (May 13, 2003) ( "the Sales and Use Tax Ordinance ") and such 17 other duties as may be prescribed by law. 18 Section 2. The Committee shall be composed of seven residents selected as 19 follows 20 (a) Position 1 shall be a certified public accountant; 21 (b) Position 2 shall be a registered professional engineer; 22 (c) Position 3 shall be a member of the Little Rock Planning Commission; 23 (d) Position 4 shall be a person nominated by the Neighborhood Connection, 24 and shall be selected from among up to five (5) nominations submitted to 25 the Board of Directors by the Neighborhood Connection to fill any 26 vacancy in this position; 27 (e) Positions 5 and 6 shall be selected at- large; (Page 1 of 31 I (f) Position 7 shall be a person nominated by Little Rock -NOW and shall be 2 selected from among up to five (5) nominations submitted to the Board of 3 Directors by Little Rock -NOW to fill a vacancy in this position. 4 Section 3. The term for a position on the Committee shall be three (3) years. 5 Section 4. At the end of the first three -year term for Position 7, the selection of 6 a person to fill Position 7 shall be an at -large position within the City, and shall not be 7 required to be a member, or a nominee, of Little Rock -NOW. 8 Section 5. The Committee shall elect one of its members as a chair who shall 9 serve a two -year term. Other members of the Committee shall serve three year terms to which shall be staggered by lot at the first meeting of the Committee with two members 11 serving three -year terms, two members serving two -year terms, and two members 12 serving a one -year term. Any member of the Committee shall be eligible to succeed 13 themselves in accordance with City policy. 14 Section 6. (A) Prior to appropriations by the City Board of Directors of any 15 funds collected pursuant to the Sales Tax Ordinance, the City Manager shall report 16 monthly to the Committee concerning use of funds collected pursuant to the Sales Tax 17 Ordinance. The report shall be in writing and submitted to the Committee for as long 18 as the funds collected pursuant to the Sales Tax Ordinance are unexpended. The report 19 shall describe: (1) proposed expenditures of funds collected pursuant to the Sales Tax 20 Ordinance; (2) money expended from all sources, including the tax authorized by the 21 Sales Tax Ordinance, on all streets and drainage within the City; and (3) the status of 22 construction and planning for all streets and drainage in the City. 23 (B) In the absence of an emergency situation such as an Act of God, a terrorist act 24 or an act of war, no appropriation or expenditure of funds collected pursuant to the 25 Sales Tax Ordinance shall be authorized by any person until the report described in 26 sub - section (A) hereof has been submitted to the Committee for a period of ten days. In 27 the event a proposed expenditure is objected to by a majority of the Committee, no [Page 2 of 3] I money shall be expended for the proposed expenditure to which an objection has been 2 made until appropriated by the City Board of Directors after a public hearing. In the 3 event of such objection then (1) the resolution or ordinance to authorize the expenditure 4 shall not be treated as a consent or grouped item, and (2) the Chair of the Committee, or 5 his designee, shall be provided sufficient time at the Board meeting to outline and 6 discuss the objection of the Committee. 7 Section 7. Severability. In the event any title, section, subsection, subdivision, 8 paragraph, subparagraph, item, sentence, clause, phrase, or word of this Ordinance is 9 declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 10 shall not affect the remaining portions of the Ordinance which shall remain in full force 11 and effect as if the portion so declared or adjudged invalid or unconstitutional was not 12 originally a part of the Ordinance. Section titles are for identification only and do not 13 constitute operative parts of this Ordinance. 14 Section 8. Repealer. All ordinances, resolutions, bylaws, and other matters 15 inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. 16 Section 9.
