WHEREAS, the Building Codes staff has met to review the current provisions of
construction working hours as they relate to new and existing conditions in structures,
m
WHEREAS, the Building Codes staff has developed the following set of
amendments to the revised code which are recommended for adoption by the Little
Rock Board of Directors, in order to strengthen and clarify standards of allowable
construction hours in the City, and
WHEREAS, such amendments are appropriate and necessary for the health,
safety and welfare of citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
OF THE CITY OF LITTLE ROCK, ARKANSAS.
Section 1. This section of Little Rock, Arkansas Revised Code (1
hereby added:

including erection, excavation, demolition, or repair of any building and
its components shall be allowed between the hours of 6:00 a.m. — 6:00
p.m., Monday — Friday, 7:00 a.m. - 6:00 p.m. on Saturdays, and 1:00 p.m. —
6:00 p.m. on Sundays. Additional interior construction work shall be
allowed to be performed between the hours of 6:00 p.m. — 10 p.m.,

1 Monday — Saturday provided that all exterior openings are completely
2 covered. These construction hours shall be adhered to except in the case
3 of urgent emergency in the interest of public health and safety and then
4 only with written permission from the Building Codes Division, which
5 permission may be granted for a period not to exceed (30) thirty days
6 while the emergency continues. If an emergency arises when permission
7 is not obtainable, the necessary work may be done and reported to the
8 Building Codes Division at the earliest date that the office is open after the
9 emergency arises and may grant permission retroactively to the beginning
10 of the emergency. If the Building Codes Division should determine that
11 the public health and safety will not be impaired by the erection,
12 demolition, excavation, alteration or repair of any building within the
13 designated hours and if they shall further determine that loss of
14 inconvenience would result to any party in interest, they may grant
15 permission for such work to be done within such hours upon application
16 being made at the time permit for the work is obtained. The Building
17 Codes Division may stop construction work at anytime when the work
18 disrupts or causes excessive disruptions of adjoining businesses or
19 residential occupancies or is found to be detrimental to the health, safety
20 and welfare of citizens.
21 2. Working Hours Permit: In cases where construction related work can
22 only be performed other than the hours listed in 8 -4 -(1) and 18 -52-
23 (13)(12)(1), a temporary work permit may be issued by the Building Codes
24 Division. Applicant must obtain permit prior to commencement of work
25 and all referenced job construction permits must be obtained. If approved
26 the permit may be issued from one to seven days. Applicant must take all

1 precautions to avoid disturbing other adjacent occupancies. The Building
2 Codes Division reserves the right to revoke any temporary work permit if
3 work disrupts or causes excessive disruptions of adjoining businesses or
4 residential occupancies or is found to be detrimental to the health, safety
5 and welfare of citizens.
6 Section 2. This section of Little Rock, Arkansas Revised Code (1988) Sec. 18-
7 52(B)(12) is hereby deleted in its entirety and the following language shall be
8 substituted therefore:

12 its components shall be allowed between the hours of 6:00 a.m. — 6:00
13 p.m., Monday — Saturday and 1:00 p.m. — 6:00 p.m. on Sundays.

15 between the hours of 6:00 p.m. — 10 p.m., Monday — Saturday provided
16 that all exterior openings are completely covered. These construction

20 Section 2. Severability. In the event any title, section, paragraph, item,
21 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
22 or unconstitutional, such declaration or adjudication shall not affect the remaining
23 portions of the ordinance which shall remain in full force and effect as if the portion so
24 declared or adjudged invalid or unconstitutional was not originally a part of the
25 ordinance.

1 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters
2 inconsistent with this ordinances are hereby repealed to the extent of such
3 inconsistency.
