AN ORDINANCE TO VACATE AND ABANDON A 50 -FOOT
WIDE BATTLE ROAD RIGHT -OF -WAY FROM WEST 65TH
STREET NORTH TO THE UNION PACIFIC RAILROAD RIG,N GI p, °
OF-WAY, IN THE CITY OF LITTLE ROCK, ARKANSAS;,
FOR OTHER PURPOSES.
Whereas, a request was made by abutting property owners,
right -of -way described below pursuant to its general police power authority
Code Ann. § 14 -54 -104;
Whereas, the Board has determined that the abandoning of the 50 -foot wide
Battle Road right -of -way from West 65th Street North to the Union Pacific Railroad
right -of -way, for private access and development will not have an adverse impact on
the adjacent property owners nor the public welfare and safety, and therefore, the
right -of -way abandoned by this ordinance is no longer needed for corporate purposes
except as otherwise noted below.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates, and abandons the

right -of -way of the City of Little Rock, less and except the reserved public utility
easements, together with the right of public in general, in and to the 50 -foot wide Battle
Road right -of -way from West 65th Street North to the Union Pacific Railroad right -of-
way, in the City of Little Rock, Pulaski County, Arkansas.
Section 2. The City specifically reserves a public utility and drainage easement
within the right -of -way.

Section 3. A copy of this ordinance duly certified by the City Clerk, shall be
filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
of Pulaski County, Arkansas.
