CODE § 34 -1 TO § 34 -97 (1988), TO 6 INCREASE THE AMOUNTS OF AUTOMOBILE INSURANCE 7 REQUIRED FOR TAXICAB FRANCHISES EXISTING AFTER 8 NOVEMBER 18, 1997, AIRPORT SHUTTLE SERVICES AND 9 SPECIALIZED TRANSPORTATION SERVICES; TO PROVIDE 10 $25,000 AS THE MAXIMUM DEDUCTIBLE AMOUNT FOR THE 11 REQUIRED INSURANCE; TO DECLARE AN EMERGENCY; 12 AND FOR OTHER PURPOSES. 13 14 WHEREAS, on November 18, 1997, the City adopted a new Transportation 15 Code, codified at Little Rock, Ark., Rev. Code § 34 -1 to § 34 -97, that governs 16 transportation franchises of vehicles for hire, and 17 WHEREAS, there is now a desire to amend Section 34- 20(a)(2) -(4) of the 18 Transportation Code to increase the amounts of automobile insurance required for 19 taxicab franchises existing after November 18, 1997, airport shuttle services and 20 specialized transportation services to two hundred fifty thousand dollars ($250,000.00) 21 for the injury or death of any one (1) person and subject to that limit for each person; 22 five hundred thousand dollars ($500,000.00) maximum liability for each accident; and 23 two hundred fifty thousand dollars ($250,000.00) for each accident regarding damage to 24 property, and 25 H [Page 1 of 41 Ordinance Transportation Code — Insurance Requirements s W 1 WHEREAS, there is also a desire to amend Section 34- 20(a)(2) -(4) of the 2 Transportation Code to provide that the maximum deductible amount allowed for 3 the automobile liability insurance required for taxicab franchises existing after 4 November 18, 1997, airport shuttle services and specialized transportation services 5 shall be twenty five thousand dollars ($25,000.00). 6 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 7 OF THE CITY OF LITTLE ROCK, ARKANSAS: 8 Section 1. Little Rock, Ark., Rev. Code § 34- 20(a)(2)(1988), Insurance, is 9 hereby amended to read as follows: 10 (2) For taxicab franchises existing after November 18, 1997: two 11 hundred fifty thousand dollars ($250,000.00) for the 12 injury or death of any one (1) person and subject to that 13 limit for each person; five hundred thousand dollars 14 ($500,000.00) maximum liability for each accident; and 15 two hundred fifty thousand dollars ($250,000.00) for 16 each accident regarding damage to property. The 17 maximum deductible amount allowed for the required 18 automobile liability insurance shall be twenty five 19 thousand dollars ($25,000.00). 20 Section 2. Little Rock, Ark., Rev. The maximum deductible amount allowed for the required automobile liability insurance shall be twenty five thousand dollars ($25,000.00). Section 3. Little Rock, Ark., Rev. Code § 34- 20(a)(4)(1988), Insurance, is hereby amended to read as follows: (4) For specialized transportation service: two hundred fifty thousand dollars ($250,000.00) for the injury or death of any one (1) person and subject to that limit for each person; five hundred thousand dollars ($500,000.00) maximum liability for each accident; and two hundred fifty thousand dollars ($250,000.00) for each accident regarding damage to property. The maximum deductible amount allowed for the required automobile liability insurance shall be twenty five thousand dollars ($25,000.00). Section 4. Repealer. All ordinances, particularly Little Rock, Ark., Ordinance No. 17,616 (November 18, 1997), resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. Section 5. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance. Since the City's Transportation Code was intended to be a comprehensive codification of ordinances dealing with for -hire transportation within the City of Little Rock, Arkansas, and such regulation is essential to protect the public health, safety and welfare, an emergency is declared to exist and this ordinance shall be in full force and effect from and after the date of this adoption.
