2 AN ORDINANCE GRANTING A FRANCHISE TO AFCO
3 STEEL, INC. FOR AIR RIGHTS ABOVE THOMAS STREET
4 FOR THE CONTINUED USE, OPERATION,
5 MAINTENANCE AND REPAIR OF TWO EXISTING CRANE
6 RUNWAYS OVER THOMAS STREET.
7 WHEREAS, the Little Rock Board of Directors has been asked to grant a
8 Franchise to AFCO Steel, Inc. for two existing overheard cranes that extend over Thomas
9 Street, and
10 WHEREAS, the two cranes connect with separate buildings which are part of the
11 steel plant and have been in use by the company without a franchise for over fifty years,
12 and
13 WHEREAS, AFCO Steel, Inc. has been sold and the buyer desires to verify that
14 the cranes can continue to be used and, operated, maintained and repaired over the right -
15 of -way of Thomas Street under authority of the Little Rock Board of Directors, and
16 WHEREAS, the Little Rock Board of Directors desires to grant the Franchise to
17 the AFCO Steel, Inc. and to its successors and assignees for so long as the cranes exist
18 and as long as the grantee of this Franchise shall operate and maintain the cranes in
19 compliance with City codes and ordinances.
20 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF
21 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. The Little Rock Board of Directors approves and grants a Franchise to
23 the AFCO Steel, Inc. and to its successors and assigns in perpetuity, to use a portion of
24 airspace above Thomas Street in Little Rock, Arkansas.
25 Section 2. The Franchise is granted for the purpose of the use, occupancy,
26 operation, maintenance (which shall include replacement and rebuilding the existing
27 structures at the same locations and dimensions) and repair of two existing crane runways
28 connecting separate buildings of the company's steel manufacturing business located on

I both sides of Thomas Street between Sixth Street and Ninth Street in Little Rock,
2 Arkansas (the "Property").
3 Section 3. The two (2) crane runways run east and west between shop buildings
4 within the facility across Thomas Street which is twenty (20) feet wide. Each crane
5 runway is fifty -seven (57) feet wide. The cranes are located parallel to each other sixteen
6 (16) feet apart. One of the cranes is rated at ten (10) tons and the other crane is rated at
7 fifteen (15) tons. The distance from the underside of each crane runway to the surface of
8 Thomas Street is 23 feet 7 inches. The distance from the underside of each crane cab to
9 the surface of Thomas Street is 16 feet 7 inches.
10 Section 4. The structures permitted by this Franchise shall be used, occupied,
11 operated, repaired and maintained in compliance with City codes and ordinances for the
12 life of this Franchise.
13 Section 5. This ordinance shall be in full force and effect from and after its
14 passage and it shall benefit and run in favor of future owners of the Property and
15 successors and assigns of AFCO Steel, Inc. until such time as the crane runways are
16 demolished and removed with the intent to permanently abandon the same. Upon any
17 abandonment, AFCO Steel, Inc. or any successor or assign shall remove the structures
18 without any cost or expense to the City.
