HomeMy WebLinkAbout18712ORDINANCE NUMBER 18,712 2002161979 07/19/2002 02:59:44 PN Filed 8 Recorded in Official Records of CAROLYN STALEY PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $17.00 AN ORDINANCE ESTABLISHING STAGECOACH VILLAGE MUNICIPAL MULTI PURPOSE PROPERTY OWNERS' IMPROVEMENT DISTRICT NO. 12 OF LITTLE ROCK,ARKANSAS WHEREAS, the parry claiming to be the owner of the real property located within the territory hereinafter described, has filed its petition praying that an improvement district be established for the purposes hereinafter set out, and WHEREAS, after ascertaining that the petition was signed by the owner of the real property within the territory, now, therefore, BE IT ORDAINED by the Board of Directors of the City of Little Rock, Arkansas: SECTION 1. There is hereby established an improvement district embracing the following real property in the City of Little Rock, County of Pulaski, State of Arkansas, to -wit: M N A _ ••vvvv vv a['0,p °e es° �� GLf7C ee That part of the Northwest Quarter of the Northeast Quarter and all that part of the Southwest Quarter of the Northeast Quarter of Section 5, Township 1 South, Range 13 West more fully described as follows: Beginning at a 44 rebar at the southwest corner of the North Half of the Northeast Quarter, said Section 5, and run thence North 2 °38'32" East along the west line of said NW '/4 NE '/4 for 792.37 feet to a 2" iron pipe; thence South 86 °55'20" East for 319.00 feet to a #4 rebar; thence South 87 °07'47" East for 531.03 feet; thence South 7 149'26" West for 134.15 feet to the northern most point of Lot 3, Stagecoach Village Subdivision to the City of Little Rock, Arkansas; thence South 32 °33'27" West along the west line of said Lot 3 for 273.93 feet; thence South 4 °21'37" West along the west line of said Lots 3 and 4 for 464.07 feet to a point on the south line of said NW '/4 NE %4; thence South 4 °21'37" West for 14.40 feet to an established fence line; thence the following course along said fence line: North 83 °23'52" West for 83.67 feet, North 84 °35'08" West for 100.00 feet, North 84 °14'08" West for 100.00 feet, North 83 °58'08" West for 100.00 feet, North 83 °47'08" West for 100.00, North 84 °07'08" West for 100.00, North 84 °12'08" West for 89.00 feet, North 70 149'08" West for 16.00 feet, North 2 028'06" East for 18.16 feet to the point of beginning, containing 14.1 acres more or less. for the following purposes: A. To acquire by purchase (by contract or eminent domain) or gift, or to construct, either within or without the boundaries of the district, if the property within the district will be benefited thereby, a sanitary waterworks distribution system, including if necessary a source, treatment and distribution system, and all other appurtenances necessary or useful and convenient for the operation and maintenance of such system, including the rights -of -way essential thereto, within and outside the boundaries of the district; and, to construct such other improvements, directly or indirectly connected therewith, as may be required by the City of Little Rock or the County of Pulaski and other governmental authorities as prerequisites or conditions to lawfully and properly completing the intents and purposes of the district; and If deemed advisable and in accordance with applicable laws, to have the right, but not an obligation, to connect the system to the waterworks system of the City of Little Rock or other municipality, association or improvement district by the acquisition or construction of proper water lines, either within or without the boundaries of the district, if a reasonable and realistic opportunity to do so should develop and if the property within the district will be benefited thereby; and To operate and maintain any such waterworks system and facilities. B. To acquire by purchase (by contract or eminent domain) or gift, or to construct, either within or without the boundaries of the district, if the property within the district will be benefited thereby, a sewage collection system and a sewage treatment plant, intercepting sewers, outfall sewers, force mains, pumping stations, ejector stations, and all other appurtenances necessary or useful and convenient for the collection and treatment, purification and disposal of industrial or domestic sewage, including the rights -of -way essential thereto, within and outside the boundaries of the district; and, to construct such other improvements, directly or indirectly connected therewith, as may be required by the City of Little Rock or the County of Pulaski and other governmental authorities as prerequisites or conditions to lawfully and properly completing the intents and purposes of the district; and If deemed advisable and in accordance with applicable laws, to have the right, but not an obligation, to connect the system to the wastewater system of the City 2 • 0 of Little Rock or other municipality association or improvement district by the acquisition or construction of proper sewage lines, either within or without the boundaries of the district, if a reasonable and realistic opportunity to do so should develop and if the property within the district will be benefited thereby; and To operate and maintain any such wastewater system and facilities. C. To acquire by purchase (by contract or eminent domain) or gift and to construct, operate, supervise, maintain and replace within and outside the district recreational and common areas and facilities related thereto, including but not limited to, green areas, landscaped areas, district lighting improvements, street lighting improvements, playground facilities, water way or wet area construction, swimming pools and tennis courts, as the Board of Commisioners should subsequently decide, along with access easements thereto, and other improvements necessary or desirable to enhance the use and benefits of such areas and improvements beyond the boundaries of the district to obtain its desired effect. D. To grade, drain, pave, curb, gutter and otherwise construct streets, roads and highways and laying sidewalks and to operate and maintain such improvements. E. To accomplish any and all other purposes authorized by law, specifically including but not limited to those intents and purposes stated in Arkansas Code Annotated Sections 14 -94 -101 et seq. The district shall be known as "Stagecoach Village Municipal Multipurpose Property Owners' Improvement District No. 12 of Little Rock, Arkansas;" and Joe L. "Bud" Finley, Olan J. Asbury and Caroline M. Finley, who are, or shall be, owners of real property within the district, are hereby named commissioners and shall compose the Board of Improvement for the district and may proceed with the district's affairs as authorized by law and set forth in the petition filed in request of this Ordinance. SECTION 2. There is hereby declared to be an existing emergency in that there is an immediate need for the formation of this improvement district to promote and protect the health, safety and welfare of the citizens of Little Rock, Arkansas, and this ordinance shall be in full force and effect from and after its passage. 3 PASSED: JULY 2 ,2002 ATTEST: N cy Wo d, City Clerk APPROVED: rad azort, Vice Mayor 4
