3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 28 -28
4 (1988) TO MODIFY THE RATES FOR SOLID WASTE COLLECTION
5 SERVICES; TO DECLARE AN EMERGENCY; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, in Little Rock, Ark., Resolution No. 11,171 (December 4, 2001), the Board of
9 Directors authorized the issuance of a City solid waste revenue bond issue, the proceeds of which will be
10 used to build an additional cell at the City sanitary landfill facility, and
I i WHEREAS, the City has commissioned a study of its solid waste needs, including the need
12 for the construction of an additional cell at the City's sanitary landfill, and
13 WHEREAS, the most appropriate method to repay these revenue bonds would be from the
14 rates charged for the collection of solid waste and recycled materials within the City, and
15 WHEREAS, in Little Rock, Ark., Resolution No. 11,288 (May 14, 2002), the Board
16 determined that solid waste collection services would be the responsibility of the City Public Works
17 Department, and specified the services to be provided for residential solid waste collection and
18 disposal,
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
20 THE CITY OF LITTLE ROCK, ARKANSAS:
21 Section 1. Little Rock, Ark., Rev. Code § 28 -28 (1988) is hereby amended to read as
22 follows:
23 (a) Each dwelling unit will be charged without exception the sum of eighteen
24 dollars and ninety -one cents ($18.91) per month. Each billing unit will be
25 provided a single city owned solid waste container (supercart). Fees shall be
26 collected monthly and may be billed on the statement for water for said premises,
27 or some similar system approved by the City Manager, and shall be the debt and
28 obligation of the person, firm, or corporation in whose name the water meter is
29 listed.

1 Section 2. Services. The services to be provided for the rate set forth in Section 1 of this
2 ordinance shall include the collection of garbage which is placed in City - provided containers, and
3 also garbage, bulky items, and yard waste collection to include vacant and boarded -up houses and
4 materials located in the right -of -way in front of vacant lots, plus the collection of a limited amount
5 of wood materials. A "limited amount of wood materials" means a small number of wood boards
6 not longer than six feet that are placed next to a City container, but which do not indicate a major
7 construction, home rehabilitation, or home remodeling project.
8 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
9 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
10 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
11 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
12 was not originally a part of the ordinance.
13 Section 4. Repealer. In addition to the provisions set forth above, all ordinances,
14 resolutions, bylaws, and other matters inconsistent with this resolution are hereby repealed to the
15 extent of such inconsistency.
16 Section 5. Effective Date. The rate set forth in Section 1 of this ordinance shall be
17 come effective upon the completion and termination of the City's current agreement with
is Waste Management of Arkansas, Inc., which is currently scheduled for September 11, 2002,
19 and shall be initially collected on all bills mailed to customers after that date.
