CLERK BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 and C -3 to POD: Part of the NE 14 NW 44 of Section 19, T -2 -N, R -13 -W City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Commencing at the SE Corner of the NE '4 NW 'K Section 19, T -2 -N, R -13 -W; Thence N 00 °31'03" E 470.19'; Thence N 88 °56150" W 51.15'; To the Point of Beginning; Thence N 88 °56'50" W 53.701; Thence S 87 °46'30" W 196.61'; Thence N 01 °02148" W 131.92' to the south Right -of -Way line on Highway 10; Thence along said Right -of -way line of Highway 10 the following Courses; Thence N 62 °15'53" E 225.451; Thence S 00 °10'08" W 4.201; Thence N 65'00103" E 15.62' to a Point being on the Arc of a Curve to the Right (said curve having a Chord Bearing Distance of S 09 "31143" E 234.81' and a Radius of 691.681); Thence S 00 °17'09" W 1.51' to the Point of Beginning, Containing 1.037 acres more or less. SECTION 2. That the preliminary site development plan /plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Branch Bank of the Ozarks Short -form POD is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 4. That the map referred of the Code of Ordinances of the City Arkansas, and designated district map be amended to the extent and in the respo affect and designate the change provided hereof. to in Chapter 36 of Little Rock, and it is hereby acts necessary to for in Section 1 SECTION 5. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
