HomeMy WebLinkAbout18622• • ORDINANCE NO.18,622 AN ORDINANCE AMENDING CHAPTERS 23 AND 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS PROVIDING FOR THE MODIFICATION OF VARIOUS FILING FEES AND PERMITS AND DECLARING AN EMERGENCY. WHEREAS, the Department of Planning and Development receives numerous requests for approval of site plans, subdivisions, requests for changes in zoning and sign permits; and WHEREAS, there is significant cost involved in the evaluation of these requests, publishing necessary notices and making sufficient copies for the public and the relevant commissions, boards and staff; and WHEREAS, there has been no significant change in the fees and permits for those requests in several years in spite of rising costs. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 23, Section 23 -3(a) fees be amended to read as follows: (a) Rezoning. That Chapter 23, Section 23 -3(b) fees be amended to read as follows: (b) Subdivision applications. That Chapter 23, Section 23 -3(c) fees be amended to read as follows: (c) Site plan applications, etc. The filing fees for submitting site plan applications and other matters listed below to the office of the city department designated by the city manager shall be as follows: (1) Subdivision Site Plan: (a) $125.00 for residential sites under 5 acres (b) $250.00 for residential sites from 5 acres to 10 acres (inclusive) (c) $350.00 for residential sites over 10 acres (d) $225.00 for nonresidential sites under 5 acres (e) $300.00 for nonresidential sites from 5 acres to 10 acres (inclusive) (f) $350.00 for nonresidential sites over 10 acres (2) Zoning Site Plan: (a) $125.00 for residential sites under 5 acres (b) $250.00 for residential sites from 5 acres to 10 acres (inclusive) (c) $350.00 for residential sites over 10 acres (d) $225.00 for nonresidential sites under 5 acres (e) $300.00 for nonresidential sites from 5 acres to 10 acres (inclusive) (f) $350.00 for nonresidential sites over 10 acres (3) Conditional Use Permits: (a) $140.00 for residential sites up to '� acre (b) $160.00 for residential sites over It acre and less than 3 acres (c) $230.00 for residential sites 3 acres and larger (d) $200.00 for nonresidential sites under 3 acres (e) $300.00 for nonresidential sites from 3 acres to 10 acres (inclusive) (f) $350.00 for nonresidential sites over 10 acres (4) Board of Adjustment, fifty dollars ($50.00) for administrative appeals and interpretations, eighty dollars ($80.00) for single- family and two - family variance applications, two hundred dollars ($200.00) for multi - family (more than two (2) dwelling units) and nonresidential variance applications and fifty dollars ($50.00) for sign variance applications. (5) Special Use Permit, one hundred thirty -five dollars ($135.00) for all sites. (6) Tower Use Permits: (a) $150.00 for all sites up to 1,i acre in area (b) $225.00 for all sites between It acre and 5 acres, in area (c) $330.00 for all sites 5 acres and larger The land area of the ownership within which the tower lease site is placed shall be the acreage used for determining the fee. (7) Land Use Plan Amendments and other appeal, waiver or requests to modify a Master Plan element shall be assessed a fee of $55.00. (8) Street Name Change Applications; one hundred fifty dollars ($150.00) (9) Easement Abandonment Applications; one hundred fifty dollars ($150.00) (10) Wireless Communication Facility Application Plan Review; one hundred dollars ($100.00) SECTION 4. That Chapter 23 Section 23 -3(d) fees be amended to read as follows: Rl 0 0 (d) Planned zoning district applications. That Chapter 23, Section 23 -3 be amended to add a new subsection (h) to be titled "Public Notice Sign Fees" and to read as follows: (h) Public Notice Sign Fees. All Rezoning, Subdivision, Board of Adjustment, Site Plan, Planned Zoning District, Tower Use Permit and Conditional Use Permit applications are to be furnished a sign for posting. The fee for provision of the sign shall be as follows: (1) All 4' X 4' signs for 10 acre and larger sites shall be assessed a $25.00 fee. (Non - refundable) (2) All signs 12" X 18 ", 18" X 24" or any other sign less than 4' X 4' square shall be assessed a fee of $5.00. (Non - refundable) (3) All applications filed for appeal, variance or waiver of Master Plan elements shall be assessed a fee of $5.00 for each sign. (Non - refundable) (4) These fees are due and payable at the time the application fee is paid. SECTION 6. That Chapter 36, Section 36- 545(e) permits be amended to read as follows: (e) All applications for permits filed with the administrator shall be accompanied by a payment of the initial permit fee for each sign according to the following schedule. That Chapter 36, Section 36- 545(h) be amended to read as follows: (h) Permits for on- premise signs are to be issued for a period of five (5) years. All sign owners are required to renew their sign permits every five (5) years prior to January 31 of the fifth year. Any sign not permitted within the month of January of the fifth year shall be classified as abandoned. On- premise signs with expired permits are illegal and shall be removed by the sign owner at his expense. SECTION S. That all other provisions of Chapters 23 and 36 of the Code of Ordinances not in conflict with this Ordinance shall remain in full force and effect. SECTION 9. Emergency. The ability to regulate proper land use zoning and signage is essential to the public health, safety and welfare, and further, requires an appropriate and consistent fee structure.
