CODE 4 §§ 32 -301; 32 -309; 32 -311; 32-403 (1988) TO ESTABLISH FINES FOR s VEHICLES ILLEGALLY PARKED IN METERED AND 6 UNMETERED SPACES; TO DECLARE AN EMERGENCY; AND 7 FOR OTHER PURPOSES. 8 J J, 9 WHEREAS, the City has established by ordinance the amounts to be 5 P.; 10 assessed to park motor vehicles in metered parking spaces within the City, and the 11 fines to be assessed for motor vehicles illegally parked in such spaces, and 12 WHEREAS, after consideration of several issues such as the number of 13 violations that occur, the cost to the City to operate and maintain parking meters, 14 and the cost to the City to assure enforcement of various parking codes, it has been 1 15 determined that an increase in the amounts charged by the City is appropriate, and ,ZE 16 that the following fee structure is reasonably related to the benefits received by the 17 persons who pay these fees, 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 19 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. Little Rock, Ark., Rev. Code § 32 -301 (1988) is hereby amended 21 to read as follows: 22 The penalty for violation of overtime parking in all metered parking 23 areas shall be: 24 (a) Ten dollars ($10.00) if paid within twenty-one (21) days of 25 the issuance of the ticket; [PAGE 1 OF 51 Ordinance Paking fines 1 (b) Fifty dollars ($50.00) if paid after twenty-one (21) days of 2 the issuance of the ticket, or after conviction in district court 3 for violation of City parking ordinances. 4 A combination ticket and envelope shall be provided as the issuance of a 5 violation citation for the convenience of motorists. The penalty shall be 6 paid by placing such sum in the penalty box attached to the parking 7 meters, or by paying the fine to the City. 8 Section 2. Little Rock, Ark., Rev. Code § 32 -309 (1988) is hereby amended 9 to read as follows: 10 The penalty for violation of overtime parking in all unmetered 11 restricted parking areas shall be: 12 (a) Thirty dollars ($30.00) if paid within twenty-one (21) days 13 of the issuance of the ticket; 14 (b) Forty-five dollars ($45.00) if paid after twenty-one (21) days 15 of the issuance of the ticket, or after conviction in district 16 court for violation of City parking ordinances. 17 A combination ticket and envelope shall be provided as the issuance of a 18 violation citation for the convenience of motorists. The penalty shall be 19 paid by placing such sum in the penalty box attached to the parking 20 meters, or by paying the fine to the City. 21 Section 3. Little Rock, Ark., Rev. Code § 32 -311 (1988) is hereby amended 22 to read as follows: [PAGE 2 OF 51 ordinance Puking fines 1 (a) It is hereby unlawful for any person to park, stand or stop a 2 vehicle in any alley except an alley used for commercial purposes and 3 then only for such time as necessary to load and unload the vehicle. 4 Commercial vehicles parked in an alley for loading and unloading shall 5 be clearly identified with permanent signage on the exterior of the vehicle 6 indicating the name and address of the business. Under no 7 circumstances shall a vehicle be parked or stopped in an alley in such a s manner as to have less than ten (10) feet of available roadway width for 9 the free movement of vehicular traffic, or to block the driveways of 10 abutting properties. 11 (b) The penalty for violation of this provision shall be: 12 (1) Thirty dollars ($30.00) if paid within twenty-one (21) days 13 of the issuance of the ticket; 14 (2) Forty-five dollars ($45.00) if paid after twenty-one (21) days 15 of the issuance of the ticket, or after conviction in district 16 court for violation of City parking ordinances. 17 A combination ticket and envelope shall be provided as the issuance of a 18 violation citation for the convenience of motorists. The penalty shall be 19 paid by placing such sum in the penalty box attached to the parking 20 meters, or by paying the fine to the City. 21 Section 4. Little Rock, Ark., Rev. Code § 32 -403 (c) (1988) is hereby 22 amended to add the following: (PAGE 3 OF 51 ordinance Parking fines • • 1 The penalty for violation of this provision shall be thirty dollars ($30.00) 2 for each consecutive period of time the motor vehicle is parked in the 3 space without being moved. A combination ticket and envelope shall be 4 provided as the issuance of a violation citation for the convenience of 5 motorists. The penalty shall be paid by placing such sum in the penalty 6 box attached to the parking meters, or by paying the fine to the City. 7 Section 5. 5everability. In the event any title, section, paragraph, item, s sentence, clause, phrase, or word of this ordinance is declared or adjudged to be 9 invalid or unconstitutional, such declaration or adjudication shall not affect the to remaining portions of the ordinance which shall remain in full force and effect as if it the portion so declared or adjudged invalid or unconstitutional was not originally a 12 part of the ordinance. 13 Section 6. Repealer. All resolutions, bylaws, and other matters inconsistent 14 with this resolution are hereby repealed to the extent of such inconsistency. 15 Section 7. Emergency. The ability to properly control on street parking within 16 the various areas of the City, and to assure that any off - street parking in restricted areas is 17 properly controlled, is essential to maintain the public health, safety and welfare; however, is because it is sometimes cheaper to simply use such public parking as a private parking lot, 19 and because it is costly to provide the operation, maintenance, inspection and enforcement 20 provisions of the City code, the current fee structure does not help to assure that this 21 important public need is met; an emergency is, therefore, declared to exist and this 22 ordinance shall be in full force and effect on January 1, 2002.
