3 AN ORDINANCE TO ESTABLISH `DARTS AND CULTURE
4 COMMISSION"; TO MERGE THE ARTS AND HUMANITIES
5 PROMOTION COMMISSION INTO THIS NEW
6 COMMISSION; TO REPEAL CERTAIN ORDINANCES IN
7 ORDER TO AFFECT THIS MERGER; TO DECLARE AN
8 EMERGENCY; AND FOR OTHER PURPOSES.
9 WHEREAS, the Arts and Humanities Promotion Commission ( "A &H'D was created by the Little
10 Rock Board of Directors to educate the community about the importance of the arts and humanities through
11 the institutionalization of such programs as Bands in the Belvedere, the AHAs, and cultural outreach, and
12 WHEREAS, A &H has educated children through cultural programs in the community centers and
13 public schools which have been adopted by other institutions as models of success, and
14 WHEREAS, A &H has influenced public policy through the development of partnerships, as well as
15 through public fora, community studies and advocacy of the arts, and
16 WHEREAS, after careful consideration, the current members of the A &H feel that they have
17 accomplished the goals set forth at the time of the A &H establishment, and that to accomplish further goals,
18 their mission should be broadened, and
19 WHEREAS, this broader mission includes creation of an atmosphere in which institutions.
20 organizations, and individuals engaged arts and culture activities can flourish, and to inspire Little Rock
21 citizens to recognize heritage and arts as essential to the whole life of the community, and
22 WHEREAS, after careful consideration the City Board of Directors has determined that the efforts
23 of the A &H should now be refocused to incorporate broader ideas, and as such, will raise the level of
24 awareness and involvement of all city residents in the preservation, expansion and enjoyment of the arts and
25 culture therefore enhance the effectiveness of citizen participation in various and related programs, and
26 WHEREAS, in furtherance of the goals and objectives that led to the creation of the A &H, the
27 Board of Directors has determined that it is in the best interests of the citizens of the City to discontinue the
28 Arts and Humanities Promotion Commission and reconstitute it into a new commission to further the efforts
29 and successes
30 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
31 CITY OF LITTLE ROCK, ARKANSAS:
32 Section 1. Article IV of Chapter 22 of LRC entitled "Arts and Humanities Promotion
33 Commission" is hereby repealed in its entirety as it relates to an Arts and Humanities Promotion
34 Commission.
35 Section 2. Article IV of Chapter 22 of LRC is hereby amended to read as follows:

25 Sec. 22 -88. Nominating Committee.
26 The Commission is authorized to establish a nominating committee for
27 the purpose of conducting the process of filling vacancies on the
28 Commission. The Commission is hereby assigned the responsibility for
29 announcing its vacancies, soliciting applications, reviewing and
30 interviewing candidates and forwarding recommendations for any and all
31 vacancies in a timely manner to the City Board of Directors.
32 Sec. 22 -84. Organization and Bylaws.
33 The Commission shall adopt such bylaws as may be necessary to
34 accomplish the purposes of its organization. The bylaws shall be

Sec. 22 -86. Establishment of Commission.

The Arts and Culture Commission of the City of Little Rock is
4
established to promote and encourage the appreciation and enhancement
5
of the arts and culture resources of Little Rock.
6
Sec. 22 -87. Membership; Appointment; Term.
7
(a) The Arts and Culture Commission shall consist of eleven (11)
8
members who shall be qualified electors of the City of Little Rock. Three
9
(3) of those members shall be senior administrative staff or a board
10
member of a cultural institution.
11
(b) The initial commissioners shall be appointed by the Board of
12
Directors. The initial appointments to the Commission shall be for one
13
(1), two (2), and three (3) year terms. Thereafter all appointments shall be
14
for a term of three (3) years or until a successor is qualified and
15
appointed. No person in the cultural institution slots shall be appointed
16
to more than one full term. No person in the at -large slots shall be
17
appointed to more than two consecutive full terms.

(c) A member of the Little Rock Board of Directors shall serve as an ex-
19
officio member of the Commission.
20
(d) The Commission may appoint any number of persons to serve on
21
subcommittees as ex- officio members. Members who are appointed to
22
fill vacancies of the unexpired terms of commissioners shall join the
23
Commission at the next meeting following their appointment and
24
confirmation.

effective n adoption by the Commission and approval by the City

Manager and subsequent notice to the Little Rock Board of Directors.

The Commission shall organize and select its officers as specified in the
4
bylaws.

Sect. 22 -90. Authority and Duties.
6
The Arts and Culture Commission shall have the authority and
7
responsibility as follows:
8
(a) to hold regular monthly public meetings and keep written public
9
records of its proceedings;
10
(b) to promote public interest in the enhancement of the arts and culture
11
resources of the City of Little Rock and its environs, and creating
12
equal access to those opportunities;
13
(c) to prepare and transmit to the Little Rock Board of Directors
14
recommended policies implementing the plans prepared by and for
15
the Commission;
16
(d) to promote and develop projects which contribute to the quality of
17
life of the city, to encourage the aesthetic development in the city
18
utilizing architectural elements, landscape, streetscape and public art
19
as a means of preservation, conservation and creation, and to
20
establish, subject to the approval of the Board of Directors,
21
regulations necessary for such programs;
22
(e) to generally stimulate, facilitate, coordinate and cooperate with
23
existing organizations for the development of the cultural traditions
24
and historical significance of the City and to initiate proposals of
25
encouragement for promotion and development of the arts, culture,
26
and tradition of the City of Little Rock;
27
(f) to promote the consideration of aesthetic or cultural issues in local
28
decision making, and to encourage the continued inclusion of
29
cultural planning in the development of the City, recognizing the
30
importance of Little Rock as the capital city and chief cultural city in
31
the state.

(g) to advocate and to express ideas, opinion and recommendations with
33
regard to the cultural and aesthetic activities assigned to it by the

I Board-of Directors and with respect to such or arts and culture
2 activities in the City.
3 Sec. 22 -91. Financial Authority.
4 (a) The Commission shall be subject to all fiscal procedures of the City.
5 (b) The Department of Parks and Recreation shall be responsible for
6 relaying any budget requests of the Commission to the City Manager
7 and to the Board of Directors. The Commission shall have the
8 authority to accept any and all public and private donations in
9 furtherance of its goals and objectives as specified in this article, and
10 the City shall establish a separate account to maintain such funds.
11 Section 4. Severability. In the event any section, paragraph, item, sentence, clause, phrase,
12 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration
13 or adjudication shall not affect the remaining portions or the ordinance which shall remain in full
14 force an effect as if the portion so declared or adjudged invalid or unconstitutional was not originally
15 part of the ordinance.
16 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
17 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
18 inconsistency.
19 Section 6. Emergency. The development of appropriate criteria and procedures for the fulfillment of
20 the various functions, is deemed essential to the pubic health, safety, and welfare, particularly in order to assure
21 that there is no confusion by the public as to what entity within the City shall be responsible for the performance
22 of various functions that will be the responsibility of this new commission; an emergency is, therefore, declared to
23 exist, and this ordinance shall be in full force and effect from and after the date of its passage.
