AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT
IN LOT 15R AND 79 OF SUBDIVISION, AN ADDITION TO THE
CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of the City of
Little Rock, Arkansas on the 9TH day of October 2001, asking the Little Rock Board of
Directors to vacate all that portion of the public utility easement designated on the Lot
15R Glenhaven Subdivision, an addition to the City of Little Rock, Arkansas, now
appearing of record in Plat Book 37, page 69, in the office of the Recorder of Pulaski
County, Arkansas.
WHEREAS, after due notice as required by law, the Board of Directors has, at
the time and place mentioned in the notice, heard all persons desiring to be heard on the
question; has ascertained that the easement, or portion thereof, hereinbefore described has
been dedicated to the public use as a utility easement; herein described; has not been
actually used by the public generally for a period of at least five (5) years subsequent to
the filing of the plat; that all owners of the property abutting upon that portion of the
utility easement to be vacated have filed with the Board their written consent to this
action; and that public interest and welfare will not be adversely affected by the vacating
of the utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons
all its rights, together with the rights of the public generally, in and to the utility easement
designated as follows:
PROPERTY DESCRIPTION FOR UTILITY ABANDONMENT
Being a part of the SW 1/4 SW '/4 Section 35, T -2 -N, R -13 -W, City of Little Rock,
Pulaski County, Arkansas, more particularly described as follows:
Beginning at the southwest corner of Lot 12 R (being a replat of Lot 12R),
Glenhaven Subdivison City of Little Rock, Pulaski County, Arkansas, recorded in
Plat Book No. 27, page 53; thence S 87 Degrees 30'49" E, 97.21 feet to the POINT
OF BEGINNING; thence S 87 Degrees 30149" E, 10.01 feet; thence S 00 Degrees
33'50" W., 305.07 feet; thence N 67 Degrees 25'47" W, 10.79 feet; thence N 00
Degrees 33'50" E, 301.36 feet to the POINT OF BEGINNING, containing 0.0696
Acres (3032 square feet) more or less.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Office of the Recorder of Pulaski County and recorded in the records of the
County,,
