AN ORDINANCE VACATING AND CLOSING A PORTION OF RAINTREE
LANE AND OTHER UNNAMED STREET RIGHTS OF WAY STREETS IN R. D.
DUNCAN'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS,
PURSUANT TO THE ARKANSA CODE ANNOTATED SECTION 14.54 -104

WHEREAS, a petition was duly filed wit the Little Rock City Clerk on 9th Day of
October , 2001 asking the Little Rock Board of Directors to vacate and abandon a portion
of Raintree Lane and other platted but unnamed streets rights of way surrounding Blocks
7 and 8 of R. D. Duncan's Addition to the City of Little Rock, Arkansas, as designated on
the plat of said Addition now appearing of record in Plat Book 1, page 178, in the office
of the Recorder of Pulaski County, Arkansas; and
WHEREAS, after due notice as required by law, the Board of Directors has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the street hereinbefore described, as been dedicated to the public
use as a street, has not been actually used by the public generally for a period of at least
five (50 years subsequent to the filing of the plat; that all owners of the property abutting
upon the portion of the street to be vacated have filed with the City Clerk their written
consent to the abandonment; and
WHEREAS, the public interest and welfare will not be adversely affected the
abandonment; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the City of Litter �c Wrh'C " °

RAINTREE LANE RIGHT OF WAY:
An unimproved street known as Raintree Lane bounded on the north by the south
line of lot 2A White Rock Terrace Addition to the City of Little Rock, Record
Instrument: A -774, and on the south by the north line (s) of Block numbers 7 and 8,
R.D. Duncan's Addition to the City of Little Rock. Record Instrument: Plat Book 1
page 178 records of Pulaski County, Arkansas said described lane also extending
39.68 feet northerly and 40 feet westerly of the Northwest corner of said Block 7,
and 40 feet north and 30 feet east of the northeast corner of said Block 8, the last
two courses remaining parallel with the north line(s) of said blocks.

40' STREET RIGHT OF WAY "A"
An unimproved street platted 40' in width bounded on the west by the east line of
Block 6 and on the east by the west line of Block 7, both blocks shown on recorded
plat known as R. D. Duncan's Addison to the City of Little Rock, Pulaski county,
Arkansas. Record Instrument: Plat Book 1 Page 178 records of Pulaski County,
Arkansas.
30' STREET RIGHT OF WAY "B"
An unimproved street platted 30 feet in width bounded on the north by the south
line(s0 of Block numbers 7 and 8, R. D. Duncan's Addition to the City of Little
Rock. Record Instrument: Plat Book 1, page 178, R. d. Duncan's Addition to the
City of Little Rock. Record Instrument: Plat Book 1 Page 178 records of Pulaski
County, Arkansas, said street also extending an additional 30 feet southerly and 40
feet westerly of the southwest corner said Block 7 and 30 feet south and 30 feet east
of the southeast corner of said Block 8, the last two curses remaining parallel with
the south line(s0 of said blocks.
30' STREET RIGHT OF WAY "C"
An unimproved street platted 30 feet in width bounded on the west by the east line
of Block Number 8, R. d. Duncan's Addition to the City of Little Rock. Record
Instrument: Plat Book 1, Page 178 records of Pulaski County.
SECTION 2. Abutting owners of record, receiving title to the abandoned right of way
and easement shall at their cost remove all vestiges of public use and access, as many
exist; such modifications shall include, but not limited to the following:
A. Part of the south 15 feet of the area shown as "30' street Right of Way
"B "'starting at the eastern boundary of Block 6 of R. d. Duncan's Addition
and extending 522 feet to the east.
B. Part of the area shown as "30' street Right of Way `B, "' starting 15 feet west
of the southeast corner of Block 8 of Duncan's Addition and extending to the
eastern boundary of the area shown as "30' street right of way "C ".
C. The entire area shown as "30' street Right of Way `C. "'
D. Part of the area shown as "Raintree Lane 40' Street Right of Way" starting 75
feet west of the northeast corner of Block 7 of R. d. Duncan's Addition and
extending to the eastern boundary of the area shown as "30' street Right of
Way "C"
SECTION 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in
the office of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 4. This ordinance shall take effect and be in force from and after its passage
and approval.
