6 AND THE ARKANSAS RIVER; ON ENGLISH AVENUE BETWEEN
7 FROM EAST SECOND STREET TO THE ARKANSAS RIVER, ALL IN
8 THE RUSSELL'S ADDITION TO THE CITY OF LITTLE ROCK,
9 ARKANSAS: AND FOR OTHER PURPOSES.

11 WHEREAS, there was a request to abandon certain City right -of -way in the
12 Russell's Addition to the City of Little Rock, Arkansas, to become a part of the William
13 Jefferson Clinton Presidential Park, and such abandonment required that a public hearing
14 be held after publication of notice of such a hearing, and
15 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 11,127 (September 25,
16 2001), the Board set October 16, 2001, as the date for a public hearing on this question, and
17 WHEREAS, after the public hearing held in accordance with Arkansas law it was
18 determined that the abandonment of such right -of -way was in the best interests of the
19 City,
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
21 THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. The Board of Directors has declared that the following street right -of-
23 way shall be deemed abandoned, and such property will revert to the adjoining property
24 owners for use, in this case, as part of the property which comprises the William Jefferson
25 Clinton Presidential Park:
26 (a) A strip that is 60 -feet wide by 1750 -feet long on East 2

1 (b) A�ip on Byrd Street that is 60 -feet wi e by 520 feet long from Easst
2 3rd Street to the Arkansas River Bank;
3 (c) A strip that is 60 -feet wide and 400 -feet long on Industrial Drive from
4 East 2d Street to the Arkansas River Bank.
5 Section 2. Severability. In the event any title, section, paragraph, item, sentence,
6 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
7 unconstitutional, such declaration or adjudication shall not affect the remaining portions
s of the ordinance which shall remain in full force and effect as if the portion so declared or
9 adjudged invalid or unconstitutional was not originally a part of the ordinance.
10 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters
11 inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
